It is hereby declared to be the purpose and intent of this article to enhance, improve and promote the health, safety and welfare of the County of Price by establishing times of curfew for persons under the age of 18 years in the County of Price.
This article shall apply to all persons under the age of 18 years in the County of Price except in municipalities where a curfew ordinance is in existence, whereby said municipality's curfew ordinance shall control.
A person under the age of 18 years may not loiter, idle or remain upon any street, alley or public place in Price County between 11:00 p.m. and 6:00 a.m. the next day unless accompanied by his/her parents, guardian or legal custodian or unless the person is:
A. 
Pursuing the duties of his/her employment in an expeditious and orderly manner;
B. 
Going to or from a place of business or private home in an expeditious and orderly manner; or
C. 
Going to or from a school, church, civic or community-sanctioned activity in an expeditious and orderly manner.
A parent, guardian or legal custodian of a person under the age of 18 shall not knowingly permit his/her child or ward to loiter, idle or remain upon any street, alley or other public place in Price County between 11:00 p.m. and 6:00 a.m. the next day unless accompanied by his/her parents, guardian or legal custodian or unless the child or ward is:
A. 
Pursuing the duties of his/her employment in an expeditious and orderly manner;
B. 
Going to or from a place of business or private home in an expeditious and orderly manner; or
C. 
Going to or from a school, church, civic or community-sanctioned activity in an expeditious and orderly manner.
A person in violation of § 403-24 of this article shall be taken to a nearby law enforcement office for proper identification and detained until such time as the parent, guardian or person having legal custody of the person is notified and reports to the law enforcement office to sign a release for and take custody of the detained person, in accordance with § 48.19, Wis. Stats.
A. 
Any person who violates § 403-24 of this article shall be subject to a penalty as provided in Chapter 290 of the County Code plus costs and dealt with as provided in § 938.343, Wis. Stats.
B. 
Any person who violates § 403-25 of this article shall be subject to a penalty as provided in Chapter 290 of the County Code plus costs.
The Price County Department of Social Services shall be notified of any person who violates any of the provisions of this article.[1]
