It shall be an offense for anyone to take unmetered water from the distribution system of the Town of Bethany Beach for the purpose of transporting said water beyond and for use beyond the corporate limits of the Town of Bethany Beach for whatever purpose without the consent of the Town Council having been previously obtained.

Any person, firm or corporation so obtaining said unmetered water from the Town system for the purpose of transporting the same beyond and for use beyond the Town of Bethany Beach, without the consent of the Town Council or from persons delegated by it to give its consent, shall, upon conviction thereof, pay such fines as set out in Chapter 1, General Provisions, Article I, Penalties; and such persons who unlawfully supply water from the Town system shall be subject to a like fine and penalty for each offense.
This article shall not apply to the Volunteer Fire Department of the Town of Bethany Beach in its use of the Town's water in its fire protection activities within the Town of Bethany Beach or beyond the corporate limits of said Town; to the corporate limits of Bethany Beach in the use of the water produced by said Town in their normal business activities; nor to the supplying of the Town's water to the adjacent National Guard of Delaware Camp; nor to the Sussex Shore Development Company during times of emergency.
