[Ord. 8-20-68; New; N.J.S.A. 40:49-5; Ord.
#1534, 3-26-2002, amended; Ord. #1852, 2-28-2006, amended]
For violation of any provision of this chapter,
any other chapter of this Code, or any other ordinance of the Township,
where no specific penalty is provided regarding the section violated,
the maximum penalty, upon conviction, shall be a fine not exceeding
$2,000, or imprisonment for a period not exceeding 90 days, or a period
of community service not exceeding 90 days, or any combination thereof.
[Ord. 8-20-68]
Except as otherwise provided, every day in which
a violation of any provision of this chapter or any other ordinance
of the Township exists shall constitute a separate violation.
[Ord. 8-20-68]
The maximum penalty stated in this section is
not intended to state an appropriate penalty for every violation.
Any lesser penalty, including a nominal penalty or no penalty at all,
may be appropriate for a particular case or violation.
The governing body may prescribe that, for the
violation of any particular code provision or ordinance, at least
a minimum penalty shall be imposed which shall consist of a fine which
may be fixed at an amount not exceeding $100. (N.J.S.A. 40:49-5)
[Ord. #1852, 2-28-2006, added]
For penalties and fines imposed in excess of
$1,250 upon a property owner as a result of a housing or zoning violation,
prior to the imposition of the fine, such property owner is entitled
to a thirty-day period to cure or abate the violation, and is entitled
to a judicial hearing regarding the violation. After the expiration
of the thirty-day period, if the abatement has not been substantially
completed, and the court has not determined otherwise, a fine greater
than $1,250 may be imposed.
