It shall be lawful for any authorized organization, as defined in § 476 of Article 14-H of the General Municipal Law, upon obtaining the required license to conduct the game of bingo within the territorial limits of the Town of Wales, subject to the provisions of this article, Article 14-H of the General Municipal Law and Article 19-B of the Executive Law and the following restrictions:
A. 
No person, firm, association, corporation or organization other than an authorized organization licensed under the provisions of this article shall be permitted to conduct such games.
B. 
The entire net proceeds of any game shall be exclusively devoted to the lawful purposes of the organization permitted to conduct the same.
C. 
No single prize shall exceed the sum or value of $250.
D. 
No series of prizes on any one occasion shall aggregate more than $1,000.
E. 
No person except a bona fide member of any such organization shall participate in the management or operation of such game.
F. 
No person shall receive any remuneration for participating in the management or operation of any such game.
G. 
The unauthorized conduct of a bingo game and any willful violation of any provision of any such local law or ordinance shall constitute and be punishable as a misdemeanor.
H. 
It is hereby authorized to conduct games of bingo on Sundays after 2:00 p.m. under the authority of § 485 of the General Municipal Law.

This article shall be known and may be cited as the "Games of Chance Law of the Town of Wales."
This article is enacted pursuant to the option granted to the municipality by virtue of Article 9-A of the General Municipal Law of the State of New York.
A. 
The words and terms used in this article shall have the same meanings as such words and terms used in Article 9-A of the General Municipal Law, unless otherwise provided herein or the context requires a different meaning.
B. 
As used in this article, the following terms shall have the meanings indicated:
CLERK
The Town Clerk of the Town of Wales.
OFFICER
The Erie County Sheriff of the County of Erie shall be the enforcement officer in charge.

TOWN
The Town of Wales.
The Town Board of the Town of Wales hereby provides that it shall be lawful for any authorized organization, upon obtaining a license therefore as provided in Article 9-A of the General Municipal Law, to conduct games of chance within the territorial limits of the Town of Wales, subject to the provisions of this article.
The fee payable to the Town Clerk upon issuance of a license shall be in accordance with and as provided by law.
The conduct of games of chance on Sundays is authorized, except as otherwise provided in Article 9-A of the General Municipal Law.
This article shall take effect immediately if approved by the qualified electors of the Town of Wales at a referendum to be held at the same place as the general election on November 6, 1990.[1]
