Rules and regulations herein have been set forth
for the protection, safety, and enjoyment of park patrons. Park controls
are also subject to any applicable state laws and regulations.
The following terms shall carry the meanings
indicated:
PARKS
The grounds, buildings thereon, waters therein, and any other
property necessary for the operation thereof and constituting a part
thereof, which is now or may hereafter be maintained, operated and
controlled by the City of Canandaigua for public park and recreation
facility purposes. Included as parks are those known as Atwater Meadows
Park, City Pier Park, Kershaw Park, Frank Baker Park, Sonnenberg Park,
the Jefferson Memorial Park, the Telyea Street Tot Lot, Triangle Park,
Pickle Park, the Gibson Street Park, Lakefront Park, The Commons,
Lagoon Park, Northeast Park, and Canandaigua Canine Campus.

Any individual, organization or association of persons and
the singular number shall include the plural.

A. Any person
may lawfully be in a park listed herein only during the following
hours or when there are authorized programs under the supervision
and direction of the City Parks and Recreation Department:

B. The hours
of operation shall be applicable to all portions of the parks and
to any pavilion, parking lot, playground, basketball court, tennis
court, skatepark or other facility located therein except for the
pickleball courts at Sonnenberg Park where hours of court use shall
be 8 a. m. to 8 p.m.

Any group of persons, exceeding 25 in number,
utilizing park facilities shall obtain a permit at least seven days
prior to the utilization of the park facilities.

A. Vending,
hawking, peddling, soliciting orders for goods, wares or merchandise
and private/professional training of dogs shall be permitted within
City parks only by permit issued by the City in accordance with rules
and regulations to be approved by resolution of the City Council.
B. By resolution,
the City Council shall approve rules and regulations governing issuance
of permits and conduct and operations of vendors, hawkers, peddlers,
solicitors and private/professional dog trainers in City parks.
C. It shall
be unlawful for any person to engage in vending, hawking, peddling,
soliciting orders for goods, wares or merchandise and private/professional
training of dogs in City parks either:
(1) Without
a valid permit issued by the City of Canandaigua; or
(2) In
violation of any rules and regulations approved by City Council under
the provisions of this chapter.
No person shall engage in potentially dangerous
games involving thrown or propelled objects. All games of any description
must be conducted in an orderly and safe manner, with no rough and
boisterous practices allowed.

No person shall take, attempt to take, or kill,
injure or unnecessarily disturb any fish, waterfowl, birds, or animals
within park confines, except that fishing shall be allowed from Kershaw
Park, Lakefront Park, Atwater Meadows Park, Lagoon Park and the City
Pier in areas designated for such activity by the Director of Public
Works. It is prohibited to feed waterfowl within any City park.

With the exception of City Pier, City Parks
are carry-in, carry-out. Park users must carry out any litter or trash
generated by their use of the park. No person shall cast, throw or
lay any solid or liquid material on land or within park waters. At
City Pier all rubbish is to be deposited into receptacles marked for
deposit.

It shall be unlawful for any person to have,
possess, carry or consume alcoholic beverages in or upon any City
park, unless a special permit, which expressly permits such alcoholic
use, subject to the following conditions, has been granted by the
City Council.
A. Such permit shall state:
(1) The name of the person to whom it is granted.
(2) The place, date, and time during which such special
event may be conducted.
(3) The type and quantity of alcohol that will be available
at the special event.
(4) That such permit shall not be transferable.
(5) The person/organization hosting the special event
shall insure that signs and temporary barriers shall be positioned
to restrict participants at the event from taking alcoholic beverages
out of the Special Event area and into the park.
(6) The event organizers shall take all reasonable steps
to insure that event participants wishing to consume alcohol are over
the age of 21.
(7) The placement of the special event equipment, property,
structures, and/or fences shall not obstruct the public path within
the park; and
(8) The event organizers shall provide the City Clerk/Treasurer
with insurance in the amounts as set by the Clerk/Treasurer and shall
execute a hold-harmless agreement prior to the date of the event or
such special permit shall be null and void.

B. A permit for a Special event with alcohol in a City
Park may be denied by the City Council, if for any reason, in the
opinion of the City Council, the time and/or place of such special
event is deemed detrimental to the best interest of the general public.

It shall be unlawful for any person to have,
possess, carry or consume any beverage in a container made in whole
or in part of glass material in or upon any City park. For purposes
of this section, any glass beverage container within any vehicle shall
be deemed to be in the possession of any person within said vehicle.

A. No person shall bathe, wade or swim within Atwater
Meadows or Lagoon Park, and no person shall bathe, wade or swim within
Kershaw Park and Lakefront Park except at such areas as may be designated
for that purpose by the Department of Parks and Recreation.

B. Beach hours are 9:00 a.m. to 9:00 p.m. Swimming is
prohibited at any other time or at any time or location for which
there is not a lifeguard on duty.
C. Persons shall be permitted to change clothing on park
property only in facilities set aside for this purpose.
D. No person shall carry onto, possess, scatter or throw
on any bathing beach area bottles or glass containers of any kind.
E. The use of life rafts, surfboards, inner tubes and
other objects intended to support persons is prohibited in park waters
with the exception of US Coast Guard approved life vests for swimming
and children's swim aides used for instructional purposes under the
direct supervision of a responsible adult in the water with the child.
F. Diving into park waters is prohibited except under
supervised swimming programs authorized by the City of Canandaigua.
G. Snorkels are prohibited with the exception of those
used in accordance with programs of the Department of Parks and Recreation.
H. Animals are prohibited in swimming areas and beaches,
unless otherwise designated by signage.

I. Bathing with soap is prohibited in park waters.
J. Unnecessary roughness in the park water is prohibited.
K. Smoking, drinking or the consumption of foodstuffs
within the park waters is prohibited.
L. Persons with open wounds, sores, and skin infections
will not be permitted in the water.

A. No person shall drive any automobile, motorcycle,
or other motorized vehicle of traffic or burden upon any part of the
parks or parkway except for the proper drives and parking areas, or
permit the same to stand upon the drive, except vehicles of the City
of Canandaigua being used on official business. In no event shall
any person operate a snowmobile within any park.
B. Reckless driving: No person shall operate a vehicle
along or over any road or drive within the park in a reckless manner
or without due regard for the safety and the rights of pedestrians
and drivers and occupants of all other vehicles, so as to endanger
the life, limb or property of any person while in the lawful use of
the park.
C. Kershaw Park and Lakefront Park regulations.
(1) The maximum speed limit on driveways and parking areas
within Kershaw Park and Lakefront Park shall be 15 miles per hour.
(2) Vehicles exiting from Kershaw Park and/or Lakefront
Park shall stop before entering Lakeshore Drive.
(3) No vehicle shall take up more than one space in any
parking lot. Trailers are prohibited.
(4) There shall be no parking of any motor vehicle at
Kershaw Park between the hours of 9:00 p.m. and 6:00 a.m., and no
parking of any motor vehicle at Lakefront Park between the hours of
2:00 a.m. to 5:00 a.m.
(5) Traffic in the westernmost parking lot at Kershaw
Park shall be one-way, proceeding easterly.
(6) Parking is limited to two hours in the eastern half
(facing north and south) of the easternmost Kershaw parking lot.

D. Baker Park regulations.
(1) The maximum speed limit on driveways and parking areas
in Baker Park shall be 15 miles per hour.
(2) Vehicles exiting Baker Park shall stop before entering
Buffalo Street.
(3) Parking of vehicles, trailers and similar equipment
is prohibited on the southerly and easterly side of the eastern driveway
in Baker Park.
E. City Pier Park regulations.
(1) The maximum speed limit on driveways and parking areas
within the City Pier Park shall be 15 miles per hour.
(2) Vehicles exiting from the City Pier Park shall stop
before entering South Main Street.
(3) Parking within the City Pier Park is restricted as set forth in Chapter
648, Vehicles and Traffic, of the of the City of Canandaigua and violations of that chapter shall also be violations of these regulations.
(4) This chapter does not repeal and is supplemented by Article
I, Piers, Harbors and Boathouses, of Chapter
287, Boats, Docks and Waterways of the Code of the City of Canandaigua and violations of that chapter shall also be violations of these regulations.
F. Northeast Park regulations.

(1) The maximum speed limit on driveways and parking areas
in Northeast Park shall be 15 miles per hour.
(2) Vehicles exiting Northeast Park shall stop before
entering Chapel Street.
G. Sonnenberg
Park regulations.

(1) The
maximum speed limit on driveways and in parking areas in Sonnenberg
Park shall be 15 miles per hour.
(2) Vehicles
exiting Sonnenberg Park shall stop before entering Howell Street.
H. Canandaigua
Canine Campus regulations.

(1) The
maximum speed limit on driveways and parking areas in Canandaigua
Canine Campus shall be 15 miles per hour.
(2) Vehicles
exiting Canandaigua Canine Campus shall stop before entering Buffalo
Street.

A. Charges for admission to the beach at Kershaw Park
shall be collected daily for the period on and between Memorial Day
weekend and Labor Day in each year inclusive and then only between
the hours of 9:00 a.m. and 9:00 p.m. No fee shall be required of any
child under six years of age and no fee shall be required for any
resident of the City of Canandaigua upon presentation of a deposit
token which may be purchased from the Parks and Recreation Department.
B. A fee is imposed upon any nonresident entering the
beach at Kershaw Park through the designated gates or entrances, the
amount of which shall be at the discretion of the City Council.
C. A permit shall be required to all users of the Canandaigua Canine
Campus with fees determined by City Council.

Any person who shall violate any of the provisions of this chapter or of any rules or regulations promulgated pursuant to this chapter, except for violations for smoking tobacco under §
519-7H or §
519-16K, shall, upon conviction, be punishable by a fine not exceeding $250 or imprisonment in the County Jail of Ontario County for not more than 15 days, or both such fine and imprisonment. Any person who shall violate §
519-7H or §
519-16K for smoking tobacco in parks and recreation areas shall be subject to a civil penalty of $25 or community service not to exceed 20 hours. In addition, any person who shall violate any of the provisions of this chapter or any rules or regulations promulgated pursuant to this chapter shall be suspended from use of City park facilities for a period of 90 days.
