The International Fire Code, 2018 edition, including all appendices thereof, or such newer edition of the said Code then in existence, as published by the International Code Council, is hereby adopted as the Fire Code of the Borough of Lewisburg and hereafter referred to and designated as such, for the purpose of regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices and from conditions hazardous to life or property in the occupancy of buildings and premises as therein provided.
Each and all of the regulations, provisions, penalties, conditions and terms, including the issuance of permits and collection of fees therefor, of the 2018 International Fire Code are hereby incorporated herein by reference and made a part hereof as if fully set forth in this article, except as otherwise amended or revised as provided in § 152-7 of this article.
The following sections of the 2018 International Fire Code are hereby amended to read in their entirety as follows:
A. 
101.1 Title. These regulations shall be known as the "Fire Code of the Borough of Lewisburg," hereinafter referred to as "this code."
B. 
110.4 Violation penalties. Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work in violation of the approved construction documents or directive of the Fire Code Official, or of a permit or certificate used under provisions of this code, shall be guilty of a summary offense, punishable by a fine of not more than $1,000 or by imprisonment not exceeding 90 days, or both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
C. 
112.4 Failure to comply. Any person who shall continue any work after having been served with a stop-work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not less than $500 nor more than $1,000.
D. 
1103.5.3 Group I-2, Condition 2. In addition to the requirements of Section 1103.5.2, existing buildings of Group I-2, Condition 2 occupancy shall be equipped throughout with an approved automatic sprinkler system in accordance with Section 903.3.1.1. The automatic sprinkler system shall be installed prior to occupancy.
A. 
This article shall not apply to new construction that is otherwise regulated or under construction through permits issued under the Pennsylvania Uniform Construction Code and the International Codes which are mandatorily adopted by the Borough of Lewisburg thereunder (collectively the "UCC").
B. 
To the extent of any conflict between the provisions of the UCC (including, without limitation, the International Fire Code to the extent the International Fire Code is referenced by the International Building Code), the provisions of the UCC shall apply.
The frequency for inspections of the occupancy classifications set forth in Section 202 of Chapter 2 of the 2018 International Fire Code shall be as follows:
A. 
Tier I: annual inspection.
(1) 
A-1, A-2, A-4, B - kitchens with commercial hood systems, B - medical offices, H-1, H-2, H-3, H-4, H-5, I-1, I-2, I-3, I-4, R-1, R-2, R-3 and R-4. This does not include International Residential Code, one- or two-family dwellings.
B. 
Tier II: biennual inspection.
(1) 
E, F-1, M and S-1.
C. 
Tier III: triennual inspection.
(1) 
A-3, A-5, B (other than those identified in Tier I), F-2, S-2 and U.
Whenever the Fire Code Official, as defined in the 2018 International Fire Code, shall disapprove an application or refuse to grant a license or permit applied for, or when it is claimed that the provisions of the said Fire Code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Fire Code Official to the Borough Council within 30 days from the date of the said decision.
One copy of the 2018 International Fire Code, or such newer edition of the said Code then in existence, shall be on file in the offices of the Borough Secretary and the Fire Code Official and be available for public inspection in the said offices.
If any section, paragraph, subdivision, clause, or provision of this article shall be judged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision so adjudged, and the remainder of this article shall be deemed valid and effective.
Ordinance No. 81-9, enacted May 19, 1991, as amended, and all other ordinances or parts of ordinances inconsistent herewith be and the same are hereby repealed.
