§ 152-5 Adoption of fire prevention code.

The BOCA Basic Fire Prevention Code, Seventh Edition 1987, or such newer edition of the said Code then in existence, recommended by Building Officials and Code Administrators International, Inc., is hereby adopted as the Fire Code of the Borough of Lewisburg and hereafter designated as such, for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion.

§ 152-6 Incorporation by reference.

Each and all of the regulations, provisions, conditions, and terms of the said BOCA Basic Fire Prevention Code, Seventh Edition 1987, or such newer edition of the said Code then in existence, recommended by the Building Officials and Code Administrators International, Inc., as established in a standard form, are hereby incorporated herein by reference and made a part hereof if fully set out in this article, except as hereinafter modified.

§ 152-7 Violations and penalties.

A. 
Any person violating any of the regulations, provisions, conditions, or terms of the said BOCA Basic Fire Prevention Code, Seventh Edition 1987, or such newer edition of the said Code then in existence, or failing to comply therewith or any of the requirements thereof, or violating or failing to comply with any order made thereunder, or building in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or failing to comply with such an order as affirmed or modified by Borough Council or by a court of competent jurisdiction, within the time fixed herein, shall be guilty of a summary offense and, upon conviction thereof in a summary proceeding before a District Justice, be sentenced to pay a fine of not more than $1,000, plus costs of prosecution, and/or be imprisoned for a period not to exceed 90 days.
B. 
The imposition of a penalty for any violation shall not excuse the violation or permit it to continue. All persons, violating the said code shall be required to correct or remedy such violation or violations or defects within a reasonable time; and when not otherwise specified, each 10 days that prohibited conditions are maintained shall constitute a separate offense. In the event that a violation or noncompliance shall be permitted to continue beyond a period of 10 days, then in that event the hazard created by such violation or noncompliance shall constitute a public nuisance detrimental to the public health, welfare and safety, and the affected property, building, or otherwise may be removed in the abatement of such nuisance by the Borough. The costs and expenses of the abatement of the nuisance shall be assessed against the offender and shall be in addition to any fine and costs imposed hereunder, and may be collected the same as other municipal charges.

§ 152-8 Enforcement.

The said BOCA Basic Fire Prevention Code, Seventh Edition 1987, or such newer edition of said Code then in existence, shall be enforced by the Building Official of the Borough of Lewisburg.

§ 152-9 Power to amend and revise code.

The Building Official of the Borough of Lewisburg shall have the power to modify any of the provisions of the said BOCA Basic Fire Prevention Code, Seventh Edition 1987, or such newer edition of the said Code then in existence, upon application in writing by the owner or lessee, or his duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the said Code, provided that the spirit of the said Code shall be observed, public safety secured, and substantial justice done. The particulars of such modification when granted or allowed and the decision of the Building Official of the Borough of Lewisburg thereon shall be entered upon the records of the Department and a signed copy thereof shall be furnished to the applicant.

§ 152-10 Appeals from permit disapproval.

Whenever the Building Official of the Borough of Lewisburg shall disapprove an application or refuse to grant a license or permit applied for, or when it is claimed that the provisions of the said Code have been misconstructed or wrongly interpreted, the applicant may appeal from the decision of the Building Official of the Borough of Lewisburg to the Borough Council within 30 days from the date of the said decision.

§ 152-11 Copies available for inspection.

Three copies of the said BOCA Basic Fire Prevention Code, Seventh Edition 1987, or such newer edition of the said Code then in existence, are on file in the offices of the Borough Secretary and/or the Building Official of the Borough of Lewisburg, and are available for public inspection in the said offices.
