Wherever a space is marked off on any street
for the parking of an individual vehicle, every vehicle parked there
shall be parked wholly within the lines bounding that space, and it
shall be a violation of this article for any person to park a vehicle
or allow it to remain parked otherwise.

B. Parking on unimproved surfaces.
(1) Definitions. As used in this subsection, the following terms shall
have the meanings indicated:
BUILDING LINE
A line parallel or approximately parallel to the street line
and beyond on which buildings or fences may not be erected.
CORNER LOT
A residential property located at the intersection or confluence
of two or more streets such that public street rights-of-way are directly
adjacent to at least two contiguous sides of the lot.
DRIVEWAY
The primary improved or unimproved parking surface which
provides egress and ingress from a garage, carport or off-street parking
area to an adjacent street or alley.
FRONT YARD
The area from the front face of a residential structure to
the front property line or street right-of-way line or, when a structure
does not exist, the area from the front building line to the front
property line or street right-of-way.
IMPROVED PARKING SURFACE
An area used for the parking or storage of vehicles that
is overlaid or otherwise paved with concrete, asphalt, paving stones,
compacted gravel and/or stone, or other hard surfaced durable material
approved by the building official.
REAR YARD
The area from the rear face of a residential structure to
the rear property line.
SIDE YARD
The area from the side of a residential structure to the
side property line.
VEHICLE
Every device in, upon or by which any person or property
is or may be transported or drawn or moved upon a street, highway,
waterway or airway and shall include any automobile, bus, truck, tractor,
motor home, farm machinery, motorcycle, scooter, moped, all-terrain
vehicle, boat, aircraft, recreational vehicle, golf cart, go-cart,
trailer, fifth-wheel trailer, camper, camper shell, wheeled towing
frame, semi-tractor trailer, truck bed mounted on chassis, and mobile
home. This definition does not include nonmotorized bicycles, small
engine lawn mowers and devices of similar scale.
(2) Regulations.
(a)
Parking on unimproved surfaces restricted. No person shall,
upon a residential single-family, duplex, townhouse or other dwelling
lot or tract:
[1]
Cause, permit or allow the parking or storage of any vehicle
in the front yard upon any surface other than an improved parking
surface; or
[2]
Cause, permit or allow the parking or storage of any vehicle
upon the side yard or rear yard of a corner lot upon any surface other
than an improved parking surface, unless otherwise concealed from
view from all public street rights-of-way by:
[a] A solid, opaque, screening fence or wall at least
six feet in height;
[b] Vegetation consisting of a solid hedgerow of evergreen
shrubs, or trees and shrubs, providing full screening from the ground
to a minimum height of six feet;
[c] Any combination of the above that effectively conceals
the vehicle from view and accomplishes the required screening height;
or
[d] Any other form of compatible and appropriate screening
approved by the building official.
(b)
Driveways and improved parking surfaces shall be permitted and
constructed or installed only in accordance with and as provided in
the Borough's Zoning Ordinance or any other applicable Borough ordinance.
(c)
It is an affirmative defense to prosecution for parking or storing
vehicles on an unimproved surface or in an unconcealed or unscreened
manner if such vehicles are parked in the rear yard and the rear yard
is not a corner lot or directly adjacent to a public street right-of-way
other than an alley.
(3) Borough Council, or any officer or employee, including Buffalo Valley Regional Police Department police officer, of the Borough designated thereby for this purpose, is hereby authorized to give notice, either by personal service or by the United States mail, to the owner of any property whereon a vehicle is parked or stored in violation of the provisions of §
345-27B(2) of this article, directing and requiring such owner to remove the said vehicle in order to conform to the requirements of §
345-27B(2) of this article within 10 days after receipt of such notice and to also pay an administrative charge in the amount of $40. Whenever, in the judgment of the designated official, it shall appear to be impracticable to give the aforesaid notice, either because the owner cannot readily be found or because a search for the owner would entail unreasonable delay, Borough Council, or any officer or employee, including Buffalo Valley Regional Police Department police officer, of the Borough designated thereby for this purpose, may give such notice by posting conspicuously on the property whereon a vehicle is parked or stored in violation of the provisions of §
345-27B(2) of this article a notice to conform to the requirements of §
345-27B(2) of this article within 10 days after the posting of the said notice and to also pay an administrative charge in the amount of $40. If any owner shall neglect, fail or refuse to comply with the aforesaid notice and/or to pay the aforesaid administrative charge within the required period of time, such owner shall be in violation of the provisions of §
345-27B(2) of this article and shall be cited and prosecuted by the Borough, or any officer or employee, including Buffalo Valley Regional Police Department police officer, of the Borough designated thereby for this purpose, as provided in the first sentence of §
345-34 of this article.

C. Removal of vehicles. The Borough may remove any vehicle parked in a prohibited location at a prohibited time in violation of this section by towing it or having it towed at the expense of the vehicle's owner. The Borough's removal of such vehicle shall not preclude penalization of the owner thereof as provided in §
345-34 of this article.
D. St. Mary street park parking lot. Parking shall be
prohibited in the parking lot of the St. Mary Street Park located
between St. Mary Street and North Fifteenth Street every day from
dusk to dawn.

A. Except as provided in Subsection
B hereof, it shall be unlawful for any person to park, or to allow to remain parked, on any streets, or parts of streets, or in off-street metered parking lots, the following vehicles:
(1) All trucks, buses, tractors and trailers listed in Classes 4 through
13 of the attached chart published by the Federal Highway Administration;
(3) All trucks listed in Class 3 of the attached chart, unless they are able to be parked wholly within the lines or markings bounding or delineating the parking space as provided in §§
345-25 and
345-38 of this article.
B. The following vehicles are exempt from the prohibition set forth in Subsection
A hereof:
(1) Vehicles when making local deliveries, repairs or installations;
(2) Public utility vehicles conducting operations;
(3) Fire and rescue equipment;
(4) Rubbish and garbage vehicles;
(5) School and public transportation buses;
(7) Construction vehicles actively involved in construction projects;
(8) Moving vans for a period of no longer than 48 hours; and
(9) Vehicles in compliance with the provisions of §
345-31 of this article.
No person shall park a vehicle, or allow it
to remain parked, for longer than the time indicated, in any of the
following locations, at any time on the days and between the hours
indicated:

It shall be unlawful for any person to stop,
stand or park a vehicle (other than a pedalcycle) on the roadway side
of any vehicle stopped or parked at the edge or curb of any street,
except that standing or parking for the purpose of loading or unloading
persons or property shall be permitted Monday through Saturday, between
the hours of 9:00 a.m. and 11:30 a.m. and between the hours of 1:30
p.m. and 4:00 p.m., and for no longer than necessary for the loading
or unloading.

Any person who violates any provision of this
article shall, upon conviction thereof in a summary proceeding before
a District Justice, be sentenced to pay a fine of not more than $600
plus costs of prosecution, for each offense and, in default of payment
of such fine and costs, be imprisoned for a period not to exceed 30
days. Provided, it shall be the duty of the police officers of the
Buffalo Valley Regional Police Department and of parking enforcement
personnel of the Borough to report to the appropriate official all
violations of any provision of this article indicating, in each case:
the section violated; the license number of the vehicle involved in
the violation; the location where the violation took place; and any
other facts that might be necessary in order to secure a clear understanding
of the circumstances attending the violation. The police officer or
other person making the report shall also attach to or place upon
every such vehicle a notice stating that the vehicle was parked in
violation of this article. The notice shall contain instructions to
the owner or operator of the vehicle that if he/she will report to
the Buffalo Valley Regional Police Department and pay the sum of $15
within 48 hours after the time of the notice, or if he/she will place
the sum of $15, enclosed within the envelope provided, in any of the
special parking fine boxes installed at various locations within the
Borough, that act will save the violator from additional penalties
and/or prosecution. Upon the failure of any owner or operator to pay
the sum of $15 within the said period of 48 hours, the owner or operator
shall, after the said forty-eight-hour period, pay as a penalty for
and in full satisfaction of such violation the sum of $30, together
with the cost of postage and certified or registered mail should a
notice of such violation be forwarded to the said owner or operator
by United States Mail. The failure of such owner or operator to make
such penalty payment within the time and at the place so specified
for such violation shall render such owner or operator, who shall
be cited within 30 days of the violation, subject to the fine and
costs prescribed in the first sentence of this section.
