A. 
Whereas the Emergency Management Services Code, Act 1978-323, 35 Pa.C.S.A. § 7101 et seq., directs and authorizes each political subdivision of the commonwealth to establish a local emergency management agency;
B. 
Whereas York County Civil Defense is eliminated by establishing the York County Emergency Management Agency;
C. 
Whereas it is the intent and purpose of this chapter to establish an office that will ensure the complete and efficient utilization of all of the County's facilities to combat disasters resulting from enemy actions or other disasters, as defined in the Emergency Management Services Code, Act 1978-323, 35 Pa.C.S.A § 7101 et seq., the York County Office of Emergency Management will be the coordinating agency for all activity in connection with emergency management; it will be the instrument through which the County Commissioners may exercise the authority and discharge the responsibilities vested in them in the Emergency Management Services Code, Act 1978-323, 35 Pa.C.S.A § 7101 et seq., the Pennsylvania Disaster Operations Plan and this chapter. This chapter will not relieve any County department of the moral responsibilities or authority given to it in the County Charter or by local ordinance. All activities undertaken by York County shall be undertaken pursuant to and in accordance with the Emergency Management Services Code; and
D. 
Whereas each emergency management agency shall have responsibility for emergency management response and recovery within the territorial limits of the political subdivision and, in addition, shall conduct such services outside of the jurisdiction as may be required under said law.
The Emergency Management Agency shall be responsible for providing an adequate emergency program and for emergency operations, including response and recovery during disasters, in accordance with the plan and program of the Pennsylvania Emergency Management Agency.

A. 
Whereas, on or about May 9, 2004, an adverse weather event has caused or threatened to cause injury and suffering to persons and damage to property in the County of York; and
B. 
Whereas, this adverse weather condition has endangered the health, safety and welfare of a substantial number of persons in the County of York and threatens to create problems greater in scope than the County of York may be able to resolve; and
C. 
Whereas, emergency management measures are required to reduce the severity of this disaster and to protect the health, safety and welfare of affected persons in the County of York; and
D. 
Whereas, the elected officials of Windsor and Felton Boroughs have declared a disaster emergency.
We, the undersigned Commissioners of the County of York, Pennsylvania, pursuant to the provisions of Section 7501 of the Pennsylvania Emergency Management Services Code (35 Pa.C.S.A. § 7501), as amended, do hereby declare the existence of a disaster emergency in the County of York.
The York County Emergency Management Director is directed to coordinate the emergency response activities, to take all appropriate action needed to alleviate the effects of this disaster, to aid in the restoration of essential public services and to take any other emergency response action deemed necessary to respond to this emergency.
The York County Emergency Management Director is authorized to act as necessary to meet the current exigencies of this emergency by employing temporary workers, by renting equipment, by purchasing supplies and materials and by entering into such contracts and agreements for the performance of public work as may be required to meet the emergency, all without regard to those time-consuming procedures and formalities normally prescribed by law, mandatory constitutional requirements excepted.
