There is hereby established a dog park within the City of Brigantine at a location to be established by the City Manager of the City of Brigantine in consultation with the City Council of the City of Brigantine.
The hours of operation for the City of Brigantine dog park shall be from 8:00 a.m. to 8:00 p.m. These hours may be amended by the City Manager based upon the respective season or for other appropriate reasons.
Any owner of a dog, prior to allowing said dog to enter the dog park in the City of Brigantine, must complete an application and submit the same with an appropriate fee to the City of Brigantine. The application shall be in a form as approved by the City Manager or his designee. An application must be completed for each and every dog that will enter said dog park. Applications shall be available in the office of the City Clerk of the City of Brigantine or at any other location as designated by the City Manager. Upon completion of said application and the approval of the same, as well as payment of the appropriate fee as set forth herein, a dog park card shall be issued for each dog.
Prior to the issuance of any dog park card, a fee as set forth in Chapter 210 of the Code of the City of Brigantine must be paid.
Prior to the issuance of any dog park card, an owner must be in full compliance with all sections of Chapter 153 of the Code of the City of Brigantine and all appropriate New Jersey statutes. This includes, but is not limited to, having a current dog license, current rabies vaccination certificate and the signing and submission of an acceptance of risk, release and waiver form.
By entering the City of Brigantine dog park, any person agrees to accept the risk for any actions taken by or to himself or herself or his or her respective dog. As part of the application process, all dog owners are required to sign a release and waiver of liability indicating they accept all risk and indemnify and hold harmless the City of Brigantine, its agents, officers and employees. All dog owners shall be strictly liable and responsible for any actions of their dogs, including any which cause injury to other dogs or persons while in or about the dog park of the City of Brigantine. The form for the acceptance of risk, release and waiver shall be as approved by the City Manager.
A. 
The City Manager shall promulgate rules and regulations which may be enforced by any member of the Police Department of the City of Brigantine, the Department of Public Works of the City of Brigantine or the City of Brigantine Animal Control Officer. Said rules and regulations shall include, at a minimum, the following:
(1) 
Any person who brings a dog to the dog park of the City of Brigantine is responsible for the behavior of said dog and must control said dog so it will not cause injuries to other dogs or people.
(2) 
There shall be no consumption of alcoholic beverages in or about the dog park of the City of Brigantine.
(3) 
Each person bringing a dog to the City of Brigantine dog park must dispose of all fecal matter of said dog in compliance with the Code of the City of Brigantine.
(4) 
All persons bringing a dog to the dog park of the City of Brigantine are responsible for insuring that said dog only enters the appropriate area based upon the size, weight and breed of said dog.
B. 
Rules and regulations shall be posted and may be changed by the City Manager as appropriate.
Both the owner of the dog and the individual who brings a dog to the dog park, if said person is not the owner of said dog, shall be responsible for any violations of this article. A summons may be issued to either the person bringing the dog to the dog park or the owner thereof who completed the application for a dog park card, or both, in the discretion of the individual issuing a summons.
Any person who violates any portion of this article may be subject to a fine of up to $1,250, imprisonment of up to 90 days and/or community service for up to 90 days in the discretion of the Municipal Court Judge.
