This chapter shall be known and may be cited
as the "Village of Clayton Harbor Management Law."
This chapter shall apply to all navigable waters
within the jurisdiction of the Village of Clayton, which was adopted
February 26, 1996. See Harbor Management Map, page 11.
The Enforcement Officer (EO), appointed by the
Village Board, acting under the orders and jurisdiction of the Village
Board, shall have full authority in enforcement of all laws and regulations
affecting the waters, maritime facilities, and waterways within the
jurisdiction of the Village of Clayton, and he may cite alleged offenders
of the chapter.
The EO is vested with authority over and control
of all floats, wharves, docks and other facilities owned, leased,
controlled, constructed or maintained by the Village of Clayton, or
constructed or maintained by a lessee in any waters under the jurisdiction
of the Village of Clayton.
If any provision of this chapter is held invalid
or inoperative, the remainder shall continue in full force and effect
as though such invalid or inoperative provisions had not been made.
Violations of this chapter will be referred
to the Enforcement Officer.
The Village Board of Trustees may amend this
chapter after public notice and a public hearing.
