A final plan shall include a disclosure statement,
a copy of which the developer shall provide to each prospective purchaser
prior to the execution of any sales agreement for the purchase of
any unimproved lot and/or residential dwelling, including condominium
units. This disclosure statement shall set forth any special conditions
or restrictions that apply to the subdivision in question such as,
but not limited to, sidewalks, street trees, stormwater, sanitary
sewer, electric, telephone, gas, water, cable television, slope and
other easements; documents establishing homeowners' association members
rights and responsibilities, including possible assessments against
each lot or unit owner; parking restrictions; building setbacks; and
like matters which may limit the purchaser's free and unfettered use
of the lot, house and/or condominium unit being purchased. Such a
disclosure statement shall reference a business office address where
plans showing the location of any such easements, other pertinent
data and documents can be reviewed during normal business hours.
