These regulations are for the purpose of assuring
the proper construction of new roads and new streets within the Township
of Maidencreek, and to provide for the development of proper traffic
distribution throughout the Township, thereby creating conditions
favorable to the health, safety, morals and general welfare of the
citizens.
All trees, roots, stumps, brush, down timber,
rotten wood, rubbish and any other objectionable material shall be
removed from the site and shall include the removal of any obstruction
interfering with the proposed road construction for the full right-of-way
width, or as approved by the Township.
Where the surface of an existing nonskid roadway
conforms approximately to the proposed subgrade elevation, or where
an embankment less than nine inches in depth is to be made over such
roadway, the surface of the old roadway shall be scarified to a depth
of not less than four inches, to permit satisfactory reshaping, binding
and compaction of the subgrade.
Since the standards and regulations of the Pennsylvania
Department of Transportation, and of the Township, may, from time
to time, change as new and better methods for the construction of
new roads and new streets evolve, the Supervisors of the Township
reserve unto themselves the right, from time to time, as they deem
necessary to assure proper new street and new road construction in
the Township, to amend and modify, by resolution, the standards and
regulations herein set forth, of which proper public notice shall
be given, and which resolution or resolutions shall be in writing
and attached hereto, and made a part hereof.
Notwithstanding anything hereinabove set forth, whenever the provisions of this article shall be inconsistent with the provisions of Chapter
190, Subdivision and Land Development, of the Code of the Township of Maidencreek and the provisions of said chapter are more restrictive or contained more stringent requirements than are set forth in the within article, the provisions of said Chapter
190, Subdivision and Land Development, shall prevail and be applicable.
