The terms of office of the City Planning and Development Committee
shall be for five years. A member may only serve two consecutive terms.
After a break of two years, a member may be reappointed. Any vacancy
occurring in the Committee other than by the expiration of a term
shall be filled by the City Manager for the unexpired term. The City
Manager shall have the power to remove, after a public hearing, any
member of the Committee for cause. Any member will be removed for
noncompliance with the minimum requirements relating to attendance
as set in Chapter 15 of this Charter and of training as set by City
Council by local law or ordinance.
The City Planning and Development Committee shall have such
powers and duties as are given to Planning Boards pursuant to the
New York State General City Law, the Zoning Ordinance of the City
of Batavia, and any other local law, ordinance or resolution of the
City Council not inconsistent with said General City Law and Zoning
Ordinances. The Planning and Development Committee shall serve in
an advisory capacity to the City Council and shall have such powers
and duties as given by the City Council, including but not limited
to the following: developing a plan to maximize the proper use of
public and private lands as outlined in the Comprehensive Plan of
the City, to provide such advice as to assist the City Council in
developing a strategy that interprets, plans and leads in the implementation
of the land use components of the Comprehensive Plan of the City;
to review and approve or disapprove the aesthetics and architectural
design on all new construction plans and/or extensive renovations
to the exterior of any building within the City of Batavia, excluding
industrial buildings; and with authorization of Council, the power
to review and approve or disapprove site plans and plats.
