It shall be unlawful for any person to make, continue, or cause to be
made or continued any loud, unnecessary or unusual noise or any noise which
annoys, disturbs, injures or endangers the comfort, repose, health, peace
and safety of others within the Town.
The following acts among others are hereby declared to be loud, disturbing
and unnecessary noises and a public nuisance, but this enumeration shall not
be deemed to be exclusive, namely:
A. Horns, signaling devices, etc. The sounding of any horn
or signaling device on any automobile, motorcycle or other vehicle on any
street or public place of this Town, except as a danger warning; the creation
of noise by means of such signaling device for an unnecessary and unreasonable
period of time; the use of any signaling device except one operated by hand
or electricity; the use of any horn, whistle or other device operated by engine
exhaust; and the use of any such signaling device when traffic is for any
reason held up.
B. Yelling, shouting, etc. Yelling, shouting or whistling
on the public streets at any time or place so as to annoy or disturb the quiet,
comfort or repose of persons in any office, or in any dwelling, hotel or other
type of residence, or of any persons in the vicinity.
C. Construction or repairing of buildings. The creation
of a loud and excessive noise in the erection (including excavation), demolition,
alteration or repairing of any building other than between the hours of 7:00
a.m. and 9:00 p.m., except in case of urgent necessity in the interest of
public health and safety.
D. Schools, courts, churches and hospitals. The creation
of any excessive noise on any street adjacent to any school, institute of
learning, church or court while the same is in use, or adjacent to any hospital,
which unreasonably interferes with the workings of such institution, or which
disturbs or unduly annoys patients in the hospital, provided that conspicuous
signs are displayed in such streets indicating that the same is a school,
hospital or court street.
The use in, upon or on any street of the Town or at any location within
the limits of the Town of any radio, phonograph, musical instrument, bell,
whistle, loudspeaker, amplifier or device of any kind whatsoever whereby sound
therefrom is cast upon any street to promote or advertise the sale of goods,
wares or merchandise or for the purpose of advertising auction sales, sporting
events or other businesses or things advertised thereby is prohibited. Also,
any such noise from any such device at any other location within the Town
when such noise will extend beyond the limits of the property of the party
owning or occupying such premises who is responsible for making such noise
is prohibited. The provisions of this section shall not apply to motor vehicles
driven in a duly authorized parade. The use of a loudspeaker for making auction
sales on premises owned or occupied by the party selling such property or
in streets directly in front of such property then being sold or on the premises
where the real estate is being sold at auction or personal property is being
sold by the owner or occupant of such premises, provided that such personal
property was not brought to the premises for the purpose of being sold at
auction, shall not be construed as a violation of this section.
It shall be unlawful for any person in operating a motor vehicle or
motorcycle in the Town limits to create in the operation thereof any unreasonably
loud, disturbing or unnecessary noise either through causing excessive noise
from racing the motor in such vehicle or from causing the tires on such vehicle
to squeal from excessive speed or unnecessary sudden stopping or turning or
from audio equipment.
