The Legislature of the County of Putnam hereby
finds that the public health, safety and welfare of the inhabitants
of the County of Putnam will be improved and protected by the prohibition
of littering on property owned by the County of Putnam, thereby eliminating
noxious or potentially noxious materials from the ground's surface
and surface waters of Putnam County.
No person shall deposit, place, cast or throw,
or cause to be deposited, placed, cast or thrown, or consent thereto,
or aid or abet the depositing, placing, casting or throwing or accumulation,
upon any sidewalk, public place, building, structure, parking area,
lot, parcel, vacant land, ground or any other interest in real property
owned, leased or rented by the County of Putnam any filth, dirt, ashes,
garbage, wastepaper, paper, dust, rubbish, foodstuff, cans, bottles,
litter of any kind, flammable material, lighted matches, cigars or
cigarettes or any other substance unless it shall be deposited in
a suitable container provided therefor by the County of Putnam.
Any violation of any provisions of this chapter
shall be deemed a violation, and any person found guilty thereof shall
be liable to a fine not to exceed $500 and/or 20 hours of community
service or imprisonment not exceeding 30 days, or by both such fine,
community service and imprisonment. The penalties for a second violation
within a one-year period shall be a fine not to exceed $750 and/or
40 hours of community service or imprisonment as set forth above.
The penalties for more than two offenses within a one-year period
shall be a fine not to exceed $1,000 or imprisonment as set above.
Each day's violation shall constitute a separate offense.
It shall be the duty of the Sheriff of the County
of Putnam and of each deputy sheriff of the County of Putnam to enforce
the provisions of this chapter. The Sheriff or any deputy sheriff
of the County of Putnam shall issue a summons to any alleged violator
requiring his appearance before a court of competent jurisdiction.
Nothing herein shall be construed to prohibit any other duly authorized
police or peace officer from issuing a summons to any alleged violator
requiring his appearance before a court of competent jurisdiction
or otherwise enforce the provisions of the chapter.
