[Amended 8-16-2004 by L.L. No. 3-2004]
Where a district boundary line, as appearing
on the Zoning Map, divides a lot or land in single ownership as existing
at the time of this enactment, the use authorized on and the district
requirements applying to the less-restricted portion of the property
shall be construed as extending into the remaining portion of the
property beyond the district boundary lines for a distance not exceeding
35 feet. Otherwise, unless shown to the contrary on the Zoning Map,
the boundary lines of districts are the center lines of streets and
alleys or such lines extended, the center lines of creeks and waterways
or the corporate limit line as it existed at the time of the enactment
of this chapter.
The zoning regulations and districts herein
set forth and as outlined upon said Zoning Map are made in accordance
with a Comprehensive Plan for the purpose of promoting the public
health, safety, morals, convenience, order, prosperity and general
welfare of the community. They have been designed to lessen congestion
in the streets; to secure safety from fire, panic and other dangers;
to provide adequate light and air; to prevent the overcrowding of
land; to avoid undue concentration of population; and to facilitate
the adequate provision of transportation, water, sewerage, schools,
parks and other public requirements. They have been made with reasonable
consideration, among other things, as to the character of each district
and its suitability for particular uses, and with a view of conserving
the value of buildings and encouraging the most appropriate use of
land throughout the Village.
No building, structure or land shall hereafter
be used and no building, structure or part thereof shall be erected,
moved or altered unless for a use expressly permitted by and in conformity
with the regulations herein specified for the district in which it
is located, except as hereinafter provided.
