A.
No person shall construct, maintain, install or enlarge
any swimming pool in the Village of Patchogue except in compliance
with all the provisions of this ordinance and with the approval of
the Suffolk County Health Department.
B.
Any outdoor swimming pool having a depth of two feet
or more and an area of 75 square feet or more shall be enclosed by
a durable wall, barrier or fence, in accordance with the New York
State Uniform Fire Prevention and Building Code requirements, unless
such outdoor swimming pool is:[1]
(1)
Emptied when not in use or unattended; or
(2)
Covered with a suitable, strong, protective covering
fastened or locked in place when not in use or unattended. A cover
shall be considered to be of sufficient strength and securely fastened
or locked in place if, when fastened or locked in place, it will support
a minimum dead weight of 200 pounds.
C.
Every outdoor pool having a depth of more than two
feet or an area of more than 75 square feet, now existing or hereafter
constructed, installed, established or maintained, shall be completely
and continuously surrounded by a permanent durable wall, fence or
barrier in accordance with the New York State Uniform Fire Prevention
and Building Code requirements.[2]
As used in this chapter, the following terms
shall have the meanings indicated:
A receptacle for water or an artificial pool of water having
a depth at any point of more than two feet and a water surface area
of 75 square feet or more, intended for the purpose of immersion or
partial immersion therein of human beings, and including all the pertinent
equipment. Portable plastic pools are not intended to be included
in the definition.
No portion of a swimming pool outside a building,
except for the adjoining walk area, shall be located at a distance
less than five feet from any side or rear property line or building
line. Pumps, filters and pool water disinfection equipment or installations
shall be located at a distance not less than five feet from any side
or rear property line.
No person shall proceed with the construction,
installation, enlargement or alteration of any swimming pool and its
appurtenances within the Village unless permits first shall have been
obtained from the Building Inspector and/or designee.
A.
All drawings and plans for the construction, installation,
enlargement or alteration of any swimming pools and appurtenances
shall first be presented to the Building Inspector and/or designee
for examination and approval as to proper location and construction.
B.
All plans and drawings shall be drawn to a scale of
not less than 1/8 of an inch to the foot, on paper or cloth, in ink
or by some process that will not fade or obliterate. All distances
and dimensions shall be accurately figured and drawings made explicit
and complete, showing the lot line and including information pertaining
to the pool, walk and fence construction, water supply system, drainage
and water disposal systems and all appurtenances pertaining to the
swimming pool.
C.
All private residential swimming pools, appurtenances,
water supply and drainage systems shall be constructed in conformity
with the approved plans and shall not interfere with the public or
private water supply system, with existing sanitary facilities or
with the public highways.
All swimming pools shall be of the recirculation
type in which circulation of the water is maintained through the pool
by pumps.
Swimming pool walls and floors shall be constructed
of any impervious material which will provide a tight tank.
Swimming pools shall be designed to withstand
the water pressure from within and to resist the pressure of the earth
when the pool is empty to a pressure of 2,200 pounds per square foot.
No portion shall be more than 18 inches above finished grade.

A.
All outdoor swimming pools shall be completely enclosed
by a fence. All walls, fences or barriers shall be constructed in
accordance with requirements of the New York State Uniform Fire Prevention
and Building Code and in conformity with all sections of the Code
of the Village of Patchogue. All fence openings or points of entry
into the pool area enclosure shall be equipped with gates and constructed
in accordance with requirements of the New York State Uniform Fire
Prevention and Building Code and in conformity with all sections of
the Code of the Village of Patchogue. No wall, fence or barrier of
any kind shall be constructed or maintained which shall contain projections
at any point on its outer surface which present a substantial opportunity
or risk of unauthorized access to the swimming pool. Stockade-type
fencing may be erected with either side facing out. A dwelling house
or accessory building may be used as part of such wall, fence or barrier.
All gates used in conjunction with such wall, fence or barrier shall
conform to the above requirements as to height and dimensions of openings,
mesh, holes or gaps, and all gates and doors shall be equipped with
self-closing and self-latching devices for keeping the gate or door
securely closed at all times. Gates and doors shall be locked when
the pool is not in use or is unguarded or unattended.
B.
During the course of construction of an in-ground
swimming pool, a temporary fence shall be erected as required by the
Building Division.
Two or more means of egress in the form of steps
or ladders shall be provided for all swimming pools. At least one
such means of egress shall be located on a side of the pool at both
the deep end and shallow end of the pool. Steps and ladders shall
have a handrail on both sides.
Handholds shall be provided and consist of a
bull-nosed coping not over 2 1/2 inches thick for the outer inches
or the equivalent approved handhold. The handhold must be no more
than nine inches above the normal water line.
The swimming pool's circulation systems shall
consist of pumping equipment and filters, together with the necessary
pipe connections to the pool inlets and outlets. The pump equipment
and recirculation systems shall be located in an underground structure
or in an aboveground structure having a floor area of not less than
100 square feet.
The system supplying recirculated water and
make-up water to the pool shall be constructed in conformance with
the Building and Plumbing Code.
Equipment shall be provided for the disinfection
of all pool water. Disinfection shall be maintained in the pool at
a minimum free chlorine residual of 0.5 parts per million or equivalent.
Any disinfection method using materials other than chlorine compound
shall be subject to the approval of the Building Inspector and/or
designee. Gaseous chlorination systems shall not be made use of as
a disinfection method for pool water.
A.
All electrical installations provided for, installed and used in conjunction with private residential swimming pools shall be in conformance with Chapter 191, Electrical Standards, of the Code of the Village of Patchogue.
(1)
No current-carrying electrical conductors shall cross
private residential swimming pools, either overhead or underground
or within 15 feet of such pools.
(2)
The pump, recirculation and plumbing systems shall
be grounded by a copper-clad ground rod driven a minimum of six feet
into the ground.
(3)
All metal fences, enclosures or railings near or adjacent
to swimming pools which might become electrical alive as a result
of contact with broken overhead conductors or from any other cause
shall be effectively grounded.
(4)
No lighting shall be installed in connection with
a pool which shall throw rays beyond the property boundary lines.
B.
Every private residential swimming pool which employs
the use of any electrical device in connection therewith shall be
equipped with a ground fault interrupter approved by Underwriters'
Laboratories, Inc. All electrical devices used in connection with
such swimming pools must be approved by Underwriters' Laboratories,
Inc.[1]
Every swimming pool shall be equipped with one
or more throwing ring buoys not more than 15 inches in diameter and
having 25 feet of three-sixteenths-inch rope attached, and one or
more light but strong poles with blunted ends and not less than 12
feet in length for making reach assists or rescues.
The Building Inspector and/or designee periodically
shall inspect all swimming pools to determine whether or not the provisions
of the ordinance regarding health, sanitation and safety applicable
thereto are being complied with.
The fee for a permit for the erection, construction,
addition or renovation of a swimming pool shall be as set from time
to time by resolution of the Board of Trustees[2] for each 1,000 cubic feet or fraction thereof to be contained
within the proposed pool as determined by the plans and specifications
submitted with the application for permit.
Any person having been served with a notice or order to remove any violation of this chapter who fails to comply therewith within the time prescribed in said notice or order shall be deemed to have violated this chapter and shall be subject to the penalties provided in § 1-1 of the Code of the Village of Patchogue. Each day during which there is a failure to comply with provisions of this chapter or any notice or order issued by the Building Inspector and/or designee shall constitute a separate violation.
