A.
Markings on any curbs, sidewalks, streets or roadways within the Township of Chesterfield shall be placed only by the authority of the Township Committee, which decision shall be memorialized by resolution duly adopted by the governing body. The markings shall be permitted for purposes solely of regulating, warning or guiding traffic or assisting utility companies while they are performing their work and shall be established in accordance with state law.
B.
Markings shall be of the following types and shall be in accordance with state law (N.J.S.A. 39:4-191.2, as amended):
(1)
Pavement markings, including lines, arrows and word markings on the pavement.
(2)
Curb markings for parking prohibitions.
(3)
Object markings, including objects within and adjacent to the roadway.
(4)
Reflector markers, including reflector buttons, panels, delineators or similar devices within or adjacent to the roadway.
(5)
Such other types of markings as shall be permitted by state law.
C.
Exceptions.
(1)
Other authorities. Nothing herein contained shall preclude the State of New Jersey or the County of Burlington from establishing markings on roadways under their respective jurisdictions.
(2)
Temporary markings. Permits may be secured from the Township's Police Department for the placement of temporary markings that may be easily removed within a twenty-four-hour period following the event for which the markings are requested. Such markings shall be made of such materials as soluble paint or adhesive tape, and the overall size of each mark shall not exceed four inches in any dimension or, if lettering or numbers are required, four inches in height and/or width of any letter or number. The cost for a permit shall be $25. Failure to remove the markings upon the conclusion of the twenty-four-hour period constitutes a violation of this article, and the person signing for the permit shall be held personally liable for the violation.
D.
Persons liable. Any persons who actively and/or physically establish markings in violation of this article, or any persons who can be proven to be responsible for and/or to have directed the placement of markings on streets, curbs, roads and sidewalks within this Township in violation of this article, may be found guilty of violating the terms and provisions of this article.
