A. 
Juveniles. It shall be unlawful for any person under the age of 16 years to be or remain in or upon any of the streets, alleys or public places in the Town of Cicero between the hours of 10:00 p.m. and 5:00 a.m., either Eastern Standard Time or Eastern Daylight Savings Time, as the case may be, unless such person is accompanied by an adult or is in the performance of an errand or activity or duty directed by the parent, guardian or other person having the care and custody of such minor person, or whose employment makes it necessary to be upon said streets, alleys or public places during the nighttime after such specified hours.
B. 
Parents or guardians. It shall be unlawful for any parent, guardian or other person having the legal care or custody of any person under 16 years of age to allow or permit any such child, ward or other person under such age, while in his legal custody, to go or to be in or upon any of the streets, alleys or public places in the town, unaccompanied by an adult person, within the time prohibited in Subsection A, except as herein provided. Any person violating the provisions of this subsection shall, upon conviction, be fined in a sum of not less than $1 nor more than $25 or, in default of payment of any such fine, by imprisonment in the Onondaga County Jail for a term not exceeding one day for each dollar of such fine, or by both such fine and imprisonment.
A. 
Police Department. Each member of the police force, while on duty, is hereby required to warn any person willfully violating the provisions of § 85-1A, and in case such warning is disregarded, such officer shall take such child to his or her home or notify the parent, guardian or other person having legal control of such minor person, of such violation.
B. 
Town Justice. In case the parent, guardian or other person having legal control and custody of such child or minor person shall have been notified of such violation by such person and shall have refused to be held responsible for the observance of the provisions of § 85-1 of this chapter, it shall be the duty of the Town Justice, upon the arrest of any such person for the violation thereof, to inquire into the fact of such violation by such child and the condition and circumstances of such child or minor person and, if it shall appear that such child or minor person, for the want of parental care, is growing up in mendicancy or vagrancy or is incorrigible, to cause the proper proceedings to be had and taken as authorized and provided by law in such cases.
