It shall be unlawful to discard, dispose, discharge,
deposit, inject, dump, spill, leak or place any solid waste or related
items into or on any land or water in the Town.
As used in this chapter, the following terms
shall have the meanings indicated:
All putrescible and nonputrescible materials or substances
that are discarded or rejected as being spent, useless, worthless
or in excess to the owners at the time of such discard or rejection,
including but not limited to garbage, refuse, industrial and commercial
waste, sludges from air or water treatment facilities, rubbish, tires,
ashes, contained gaseous material, incinerator residue, construction
and demolition debris, discarded automobiles, and offal.

A person who violates the provisions of § 94-1 of this chapter shall be guilty of a misdemeanor and shall be punished as follows:
A.
For a conviction of a first offense, a fine of not less than $350
and not more than $500 or imprisonment for not more than 10 days,
or both.
B.
For a conviction of a second offense, a fine of not less than $500
and not more than $750 or imprisonment for not more than 20 days,
or both.
C.
For a conviction of a third or subsequent offense, a fine of not
less than $750 and not more than $1,000 or imprisonment for not more
than 30 days, or both.
