This chapter shall be known and may be cited as the "Snowmobile Ordinance of the Town of Cicero."
It is the purpose of this chapter to protect the public health, safety and general welfare by regulating the operation of snowmobiles on specified highways within the Town of Cicero in a manner which will promote their safe and proper use for recreation and commerce and minimize detrimental effects of such use on the environment.
This chapter is enacted pursuant to the provisions of Article 21 of the Parks and Recreation Law of the State of New York, hereinafter referred to as "Article 21."[1]

Snowmobiles may be operated on the following portions of highways which shall be posted and marked as provided by law, and subject to conditions and restrictions hereinafter set forth:

Whenever the operation of a snowmobile is permitted on any highway of the Town of Cicero, or any portion thereof, the following conditions and restrictions are hereby established and shall be applicable to all such snowmobile operation, pursuant to Article 21, § 25-09, Subdivision 1(d),[1] but shall not be construed as limiting or modifying the conditions, restrictions, rules or regulations relating to the operation of snowmobiles as set forth in said Article 21:
A. 
Speed limit. Snowmobiles shall not be operated on any town highway, or any portion thereof, at a rate of speed in excess of 15 miles per hour.
B. 
All drivers and riders of snowmobiles on any town highway, or any portion thereof, must wear approved motorcycle type helmets marked with a minimum of two square inches of reflective tape on each side and on the rear of the helmets.
C. 
While being operated on any town highway, or portion thereof, all snowmobiles must travel in a single lane on the extreme right side of the highway and in the same direction as the highway traffic, and shall at all times yield the right of way to all other type vehicular traffic and pedestrians.
D. 
Any operator of a snowmobile on any town highway, or portion thereof, under the age of 16 years must be accompanied by and be under the supervision of a responsible person of at least 18 years of age.
