The Borough of Marietta is hereby authorized
to join with the Township of East Donegal and the Township of Conoy,
all of Lancaster County, Pennsylvania, in accordance with the provisions
of the Pennsylvania Intergovernmental Cooperation Act, Act of July
12, 1972, No. 180, as amended (53 Pa.C.S.A. § 2301 et seq.),
by entering into a merger agreement with the Township of East Donegal
and the Township of Conoy to provide for mutual police protection
within the municipal limits of each of the three said municipalities,
which agreement shall have been approved and adopted by resolution
of the Borough Council of the Borough of Marietta with the same effect
as if it had been set forth verbatim in this section, and a copy of
which merger agreement shall be filed with the minutes of the meeting
at which said agreement is adopted.
The new police department shall be known as
the "Susquehanna Regional Police Department" and shall be organized
as an unincorporated association. Said Susquehanna Regional Police
Department shall have a perpetual existence, unless terminated sooner
in accordance with the terms of the aforementioned merger agreement,
and appropriate ordinance of the Borough of Marietta.
The total cost of operating and maintaining
the consolidated Susquehanna Regional Police Department is to be financed
by annual budget appropriations made by each participating municipality
towards such cost in a manner and subject to the conditions set forth
in the merger agreement to be entered into by the three participating
municipalities.
The Susquehanna Regional Police Department is
to be under the general supervision and control of a joint board to
be known as the "Susquehanna Regional Police Commission," consisting
of the Mayor of the Borough of Marietta, and a supervisor from the
Township of East Donegal and a supervisor from the Township of Conoy.
The organizational structure of the consolidated police department
and its police commission shall be as provided in detail in the merger
agreement.
The merger agreement shall provide that all
of the existing property and equipment of each police department shall
be contributed or transferred to the Susquehanna Regional Police Department.
Thereafter, all new purchases of property and equipment are to be
made and disposed of as is provided in detail in the said merger agreement.
The Susquehanna Regional Police Commission created
pursuant to this article shall be empowered to enter into contracts
for the purchase of property, equipment, materials, and supplies,
and shall be authorized to enter into contracts for policies of group
insurance and employee benefits, including social security, for its
employees, subject to the budgetary restrictions and other provisions
contained in the merger agreement, and the said Commission shall have
all other powers and authority as provided in said merger agreement
and not otherwise denied to it or withheld from it by the laws of
the Commonwealth of Pennsylvania.
By the passage of this article the Borough of
Marietta adopts the merger agreement between itself, the Township
of East Donegal, and the Township of Conoy, in the exact and verbatim
format of the language of said agreement which the Borough Council
of the Borough of Marietta voted by resolution in February of 1996
to enter into for purposes of creation of a joint regional police
department to be known as the "Susquehanna Regional Police Department."
The said merger agreement is incorporated herein by reference. A copy
of the said merger agreement is available for inspection, reading,
and copying, at the offices of the Borough of Marietta, at 111 East
Market Street, Marietta, Pennsylvania, during regular business hours
on all weekdays.
Upon the effective date of the merger agreement
authorized by this article, or at such time as the Susquehanna Regional
Police Department becomes operative as set forth in the said merger
agreement, whichever shall occur later, the existing Marietta Borough
Police Department shall be abolished. Said Marietta Borough Police
Department may only be reestablished by a duly enacted ordinance of
the Borough of Marietta in the future, if such reestablishment is
deemed appropriate and necessary by the Borough Council of the Borough
of Marietta.
This article shall become effective five days
from its passage and adoption by the governing body of the said municipality.
The effective date of this article does not alter or change the effective
date for the date upon which the Susquehanna Regional Police Department
becomes operative and the existing Police Department of the Borough
of Marietta is abolished.
