A certain document, being marked and designated as the "International
Mechanical Code, 1996," as published by the International Code Council,
Inc., and the Building Officials and Code Administrators International,
Inc., and the International Conference of Buildings, and the Southern
Building Code Congress International, Inc., be and is hereby adopted
as the Mechanical Code of the Township of Westtown in the County of
Chester, State of Pennsylvania, for regulating the design, construction,
quality of materials, erection, installation, alteration, repair,
location, relocation, replacement, addition to and use of mechanical
systems in the Township of Westtown, providing for the issuance of
permits and collection of fees.
The following sections are hereby revised as follows:
A. Section M-100.1, Title, shall have inserted therein "Westtown Township"
as the name of jurisdiction.
B. Section P-114.3, Fee Schedule. Permit fees for all mechanical work
shall be as determined by the Board of Supervisors of Westtown Township.
C. Section P-117.4 Penalties. Any person who violates or permits a violation
of this code shall, upon conviction in a summary proceeding brought
before a District Justice under the Pennsylvania Rules of Criminal
Procedure, be guilty of a summary offense and shall be punishable
by a fine of not more than $1,000, plus costs of prosecution. In default
of payment thereof, the defendant may be sentenced to imprisonment
for a term not exceeding 90 days. Each day or portion thereof that
such violation continues or is permitted to continue shall constitute
a separate offense, and each section of this code that is violated
shall also constitute a separate offense.
D. Section P-118.2 Unlawful Continuance. Any person who shall continue
any mechanical work in or about the structure after having been served
with a stop-work order, except such work as that person is directed
to perform to remove a violation or unsafe conditions, shall be guilty
of a summary offense and shall be punishable by a fine of not more
than $1,000, plus costs of prosecution. In default of payment thereof,
the defendant may be sentenced to imprisonment for a term not exceeding
90 days. Each day or portion thereof that such violation continues
or is permitted to continue shall constitute a separate offense, and
each section of this code that is violated shall also constitute a
separate offense.
