Pursuant to Section II of the Uniform Fire Safety Act (P.L.
1983, c. 383), the New Jersey Uniform Fire Code shall be locally enforced
in the municipality of the Township of Chester.
The local enforcing agency shall be the Fire Department serving
the Township of Chester.
The local enforcement agency shall enforce the Uniform Fire
Safety Act and the codes and regulations adopted under it in all
buildings, structures and premises within the established boundaries
of the Township of Chester, other than owner-occupied one- and two-family
dwellings, and shall faithfully comply with the requirement of the
Uniform Fire Safety Act and the Uniform Fire Code.
The local enforcing agency established by §
97-2 of this chapter shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.
The local enforcing agency established by §
97-2 of this chapter shall be a part of the Fire Department serving the Township of Chester and shall be under the direct supervision and control of the Chief of the Fire Department, who is hereby designated as the official who will supervise the activities of the agency.
Pursuant to Section 15 and 17 of the Uniform Fire Safety Act, any person aggrieved by any order of the local enforcement
agency shall have the right to appeal to the Construction Board of
Appeals of the County of Morris.
In addition to the inspections and fees required pursuant to
the Act and the regulations of the Department of Community Affairs,
the following additional inspections and fees shall be required:
A. Eating establishments with the maximum permitted occupancy of less
than 50 in which no alcoholic beverages are consumed, registration
fee: $25.
B. Retail stores and other mercantile uses containing:
(1) Less than 1,200 square feet of gross floor area, registration fee:
$25.
(2) One thousand two hundred to 12,000 square feet of gross floor area,
registration fee: $50.
(3) More than 12,000 square fee of gross floor area, registration fee:
$100.
C. Multiple-family dwellings containing:
(1) Three to six dwelling units, registration fee: $25.
(2) Six to 10 dwelling units, registration fee: $50.
(3) More than 10 dwelling units, registration fee: $100.
D. Places of business assembly, including but not necessarily limited
to office buildings, which are not otherwise defined by the code as
a life hazard use, registration fee: $75.
Pursuant to the requirements of N.J.A.C. 5:18A-3.2(d) the Municipal
Attorney of the Township of Chester is hereby designated as the legal
counsel appointed to assist the local enforcing agency to enforce
the code. Such appropriate legal counsel shall advise the agency and
undertake such actions at law as the Fire Official shall deem necessary
to gain compliance with the code within the boundaries of the Township
of Chester.
