It shall be unlawful for any person or persons, corporation, partnership, unincorporated association or any entity whatsoever to store or to accumulate or to permit the accumulation of materials capable of being scattered by wind or any of the natural elements, except when stored or accumulated entirely within a building completely enclosed on all sides, or when entirely enclosed within a fine wire mesh or other type of enclosure designed to prevent scattering of the materials.

In the event that any person or persons, corporation, partnership, unincorporated association or any entity whatsoever shall violate any of the provisions of this article, the Mayor or Borough Manager shall give them 10 days' written notice of said violation. Any person who, after said 10 days' written notice, fails to comply with this article shall, upon conviction thereof by summary proceedings, be sentenced to pay a fine not to exceed the maximum fine of $300, plus costs of prosecution, and in default of payment of such costs and prosecution, imprisonment for a term not exceeding 30 days; provided, however, that if the District Justice determines that the defendant is without the financial means to pay the fines and costs immediately or in a single remittance, such defendant shall be permitted to pay the fines or costs in installments and over such periods of time as the District Justice deems to be just.
