As used in this chapter, the following terms shall have the meanings indicated:
DISH-TYPE ANTENNA
A saucer or circular-shaped antenna functioning as an antenna for reception of television programming. Such objects are also known as "satellite dishes," "satellite earth stations" and "home video earth stations."

A property owner in the Borough of Laurel Springs is permitted to install and/or erect only one dish-type antenna on such owner's property. This dish-type antenna may be installed and/or erected either at ground level or on the rear slope of the roof of the owner's property. Installations in the front yard or in front of the building structure are hereby prohibited.

A. 
The dish-type antenna, including its foundation pad or support of structure, may not exceed a maximum height of 12 feet and may not exceed a maximum of 12 feet in diameter. These restrictions apply to ground and rooftop installation.
B. 
The dish-type antenna shall be installed and/or erected in the rear or side yard of the property. In certain instances, however, it is anticipated that there may be a lack of appropriate reception in cases of a ground-level antenna. In the instances where reception seems to be substandard, the property owner may submit a certified site survey by a recognized satellite dish company setting forth the reasons why it is necessary to erect the dish-type antenna on the property owner's roof. The certified site survey must be presented to the Laurel Springs Planning Board for review and/or approval, prior to a rooftop installation. The property owner must be able to prove to the satisfaction of the Planning Board that the roof installation is necessary because of the lack of clear reception of a ground-level antenna. The Planning Board may require that a representative of the satellite dish company appear before said Board for the purpose of testifying to the necessity for the roof installation.
C. 
A review of all dish-type antenna installations is required by the Planning Board prior to the issuance of any building permit. Such review shall include questions pertaining to location, structural soundness, appearance and adherence to the placement requirements. The Construction Official must review the application prior to the issuance of a building permit in order to ascertain that the installation conforms to the relevant Building Code standards.[1]

Each and every person violating any of the provisions of this chapter after receipt of notice as provided herein shall, upon conviction of such violation, be subject to the penalties provided in Chapter 1, § 1-15, as the Judge of the Municipal Court of Laurel Springs shall deem proper.
