The words, terms or phrases listed below, for the purpose of this chapter, shall be defined as follows:
A pool resting on or in the ground with a water depth in excess of 15 inches with sides higher than 24 inches, including those with access by ladder, ramp, steps or other means, which is constructed in such a manner that is not capable of being disassembled and stored by reason of construction design and/or materials. These pools shall require a permit for construction as provided in § 237-2. Such pools shall be properly covered by October 1 and may be reopened on or after May 1 of each year. In the case of heated pools, waivers of the opening and closing requirements may be obtained by application to the Borough Land Use Law.
A pool resting on the ground with a water depth in excess of 15 inches with sides higher than 24 inches, including those with access by ladder, ramp, steps or other means that can be disassembled for storage and transport. This includes pools with flexible or non-rigid walls that achieve their structural integrity by means of uniform shape or a support frame, or a combination thereof. These pools shall require a permit for construction as provided by § 237-2. Such pools shall be disassembled and stored by October 1 and may be opened by May 1 of each year.
Any pool used and maintained for swimming purposes by an individual or by his household and guests and located on a lot as an accessory use to a residence. This definition shall be further defined to refer to a receptacle for water or an artificial pool of water having a depth of not more than 24 inches. The term includes all appurtenant equipment constructed, installed and maintained in or above the ground for use in connection with such a private swimming pool.
Any pool which is above ground and not permanently affixed, and which must not be installed sooner than the first day of May each year and which must be removed on or before the 31st day of October of each year.
Any pool used and maintained by an individual, firm, corporation, club or association of persons for use by the public or club members and their invitees and guests. This definition extends to those swimming pools used in connection with or by any motel, hotel, apartment or community association, including both indoor and outdoor pools. These pools shall require a permit for construction as provided in § 237-2. Such pools shall be properly covered by October 1 and may be opened or reopened by May 1 of each year. In the case of heated pools, waivers may be obtained by application to the Borough Land Use Board.
An above-ground pool not designed or used for swimming which is suitable for bathing purposes with a depth of 15 inches or less or a capacity of 300 gallons or less. Such pools shall not require a permit for construction and shall be removed and stored by October 1 and may be reopened on or after May 1 of each year..
