The purpose of the Public Works Commission is to manage and oversee, under the general supervision of the Board of Selectmen, the Public Works Department.
There shall be and is hereby created, in the Town of Guilford, a Public Works Commission, the members of which shall be appointed by the Board of Selectmen. The Board shall consist of five regular members and two alternate members, who must be registered voters and residents of the Town and who shall serve without compensation, except as to those necessary expenses incurred in the performance of their duties. An alternate member, when seated in the place of a regular member, shall have all the powers and duties of a member of the Commission.
A. 
Initially, the Board of Selectmen shall appoint two regular members to the Commission for terms of two years and three regular members for terms of four years, with all terms to begin on May 19, 2008. A member shall continue to hold office until his or her successor has been appointed and has qualified. The Board of Selectmen shall appoint one alternate member to serve for a term of two years and one alternate member to serve for a term of four years or, in each case, until his or her successor has been appointed and has qualified. The initial terms of the alternate members are also to begin on May 19, 2008.
B. 
After the expiration of each initial appointment, members shall be appointed to four-year terms in accordance with Section 4-2 of the Guilford Town Charter.
After May 19 in each even-numbered year, beginning with May 19, 2008, the Board shall meet and elect a Chairperson, Vice-Chairperson, and Secretary for two-year terms, with no person to serve more than two consecutive terms in the same position.
A. 
The Board shall hold regular meetings and shall designate the time and place thereof and shall have the power to adopt rules and regulations for the conduct of its meetings and execution of its duties. Such regulations shall be filed with the Town Clerk in accordance with the Town Charter. The Board shall keep records of all its proceedings in accordance with law. Three members shall constitute a quorum.
B. 
Removal of any deficient member shall be executed in accordance with Town Charter.
The powers and the duties of the Public Works Commission shall be exercised and performed as herein provided in accordance with all Town ordinances and applicable laws. The Public Works Commission shall:
A. 
Undertake and be charged with, under the general direction of the Board of Selectmen, management and oversight of the Public Works Department, within the budget for such department as approved by the Town.
B. 
At a time determined by the Board of Selectmen, develop a proposed budget estimating anticipated expenditures and revenues for the operations of the Public Works Commission for each fiscal year.
C. 
Continually review the Town's needs with respect to public works and make such recommendations to the Board of Selectmen and other Town agencies and departments as it deems appropriate.
D. 
Establish regulations for the effective operation of the Public Works Department, including the duties of the Department, and its superintendent or director, with respect to construction and maintenance of Town buildings, highways, sidewalks, sewers and drains, the care of trees and grounds, collection and disposal of garbage and rubbish and maintenance of apparatus and equipment used by the Department of Public Works.
E. 
Review and approve, as appropriate, the Department's maintenance and care of school buildings and grounds as requested by the Board of Education and to be charged to Board of Education appropriations.
F. 
Review and approve, as appropriate, the Department's maintenance and care of beaches and parks on request of the Parks and Recreation Commission.
G. 
Review and approve, as appropriate, the Department's maintenance and repair of such other apparatus and equipment as may be used by other agencies or departments of the Town upon request of such agencies or departments.
H. 
Request assistance from any other department of the Town government in the performance of the Commission's duties and cooperate with any other department of the Town in projects of mutual interest and in the interests of the Town.
The Commission shall submit to the Town, at a time determined by the Board of Selectmen, an annual report for presentation and/or publication relative to the work of the Commission. The Commission shall submit such other reports as are requested by the Board of Selectmen from time to time.
