There is hereby established in the Borough of Dunellen a special classification of special policemen to be known and designated as the "Special Police - Parking Authority."
Every person appointed as such a special policeman shall be a citizen of the United States, shall be able to read, write and speak the English language, shall be physically able to perform his duties, shall be of good moral character and shall not have been convicted of any crime. Every such person shall also have any other qualifications which may now or hereafter be required by law for the appointment of special policemen. No person so appointed shall be required to be a resident of the Borough of Dunellen. No person shall be disqualified from such appointment because of sex.
Whenever the masculine gender is used in this article it shall also include the feminine gender.
Each such special policeman shall be appointed by the Mayor, subject to confirmation by the Borough Council. Before any appointment is made, the Chief of Police shall ascertain whether or not the applicant for the appointment is eligible and qualified, as provided in this article and under the laws of the State of New Jersey, and a report thereon shall be made to the Mayor and Council. No such appointment shall become effective until confirmed by the Parking Authority of the Borough of Dunellen, and said Parking Authority shall notify the Municipal Clerk and the Chief of Police of such confirmation, in writing, before any certificate of appointment or badge shall be issued. Each Special Policeman - Parking Authority shall be fingerprinted, and his fingerprints shall be filed with the Division of State Police and the Federal Bureau of Investigation. A fee may be charged for the issuance of a certificate of appointment, which shall be the same fee charged for such certificate to special police of the Borough of Dunellen, other than Special Police - Parking Authority.
The Mayor and Council may appoint such special policemen, in the manner provided in this article, for a term not exceeding one year and may revoke such appointment without cause or hearing. Such special policemen shall not be members of the police force, and their powers, rights and duties shall immediately cease:
A. 
At the expiration of the term for which they were appointed;
B. 
Upon revocation of their appointment;
C. 
Upon termination of the employment by the Parking Authority of the Borough of Dunellen.
The powers and duties of the special police shall be as follows:
A. 
Every such special policeman shall be under the supervision and direction of the Chief of Police of the Borough of Dunellen.
B. 
Every such special policeman shall perform his duties only in the Borough of Dunellen.
C. 
Every such special policeman shall comply with the regular rules and regulations promulgated by the Mayor and Council of the Borough of Dunellen for the conduct and decorum for the regular members of the Police Department of the Borough of Dunellen.
D. 
Such Special Police - Parking Authority shall have the power and authority to issue appropriate summons and complaints for the following violations only:
(1) 
For the overtime parking of a motor vehicle in any metered parking stall, whether on the streets or in parking lots.
(2) 
For the illegal parking of a motor vehicle in any properly posted, restricted parking stall that is reserved for the holders of parking permits issued by the Parking Authority where no proper permit has been obtained for such motor vehicle or where no proper permit is properly displayed on such motor vehicle according to the rules and regulations governing the issuance of such permit.
(3) 
For overtime parking in any area where parking is limited to a specific period of time or length of time either by ordinance or by resolution pursuant to the Parking Meter Ordinance, provided that proper signs have been erected in such area either by the Borough of Dunellen or by the Parking Authority.
E. 
Such Special Police - Parking Authority shall be under the direction and control of the Parking Authority as to hours worked and duties performed, subject to the provisions of this article.
F. 
No such special policeman shall, by virtue of his appointment under this article, carry a revolver, or other weapon.
G. 
The granting of certain powers and authority to the Special Police - Parking Authority by this article shall not remove any such powers or authority which may exist with the regular police or any other enforcement officers.
No such Special Police - Parking Authority shall, by reason of appointment by the Mayor and Council, be or be considered an employee, servant or agent of the Borough of Dunellen for any purpose connected with the workers' compensation laws of the State of New Jersey. The Parking Authority of the Borough of Dunellen shall provide workers' compensation insurance for all such special policemen and shall indemnify the Borough of Dunellen and save it harmless from any and all liability connected with the employment of such special policemen and their acts and omissions. Confirmation of the appointment of each such special policeman by the Parking Authority shall signify the acceptance of this article and the responsibilities imposed hereunder by the Parking Authority.
No such special policeman shall be entitled to receive any compensation or emolument from the Borough of Dunellen for the performance of his duties as such special policeman. Any compensation or emolument paid to such special policemen shall be paid by the Parking Authority from funds of the Parking Authority in amounts and in a manner to be determined solely by the said Authority.
