[HISTORY: Adopted by the Township Committee of the Township of Stillwater as § 11-5 of the 1971 Revised General Ordinances. Amendments noted where applicable.]
General penalty — See Ch. 1, Art. III.
Uniform construction codes — See Ch. 155.
No person shall use any Township road for the purpose of placing upon or moving thereon any building or structure without first applying for and obtaining the approval of the Township Committee.
If granted, approval shall require:
That such use be subject to and under the direction and supervision of the Township Committeeman in charge of the Road Department or his designated representative;
That the time and route of moving shall be subject to approval by the Committeeman, who shall take into consideration the safety and convenience of the traveling public, residents and property owners;
That, where deemed necessary by the Committeeman, warning signs of suitable size and visibility shall be posted 48 hours in advance of the moving;
That the person applying for approval shall be responsible for and exonerate, indemnify and save harmless the Township, its representatives and agents from and against, any and all damage to persons or property occasioned by or arising out of such use, and the person may be required to obtain appropriate insurance in such amounts as the Committee deems advisable protecting the Township, its representatives and agents against damage and injury, and
That all applicable requirements of the County of Sussex and the State of New Jersey be met.
In granting approval, the Committee may impose such additional conditions and requirements as it sees fit.
No approval shall be granted by the Township Committee if it finds that, despite the imposition of reasonable conditions and requirements, such use is incompatible with preservation of the public health, safety and welfare.
