In the event of reoccupancy, alteration, renovation, addition, change of use or ownership of a building, structure or dwelling, written application shall be made by the owner or his or her agent for a certificate of occupancy.

The Construction Code Official, with the approval of the subcode officials, shall issue a certificate of occupancy, provided that there are no violations of law or orders of the Construction Official pending and it is established after inspection and investigation of available municipal records that the alleged use of the building, structure or dwelling has lawfully existed.

The certificate of occupancy shall evidence only that a general inspection of the visible parts of the building, structure or dwelling has been made and that no violations of N.J.A.C. 5:23-2.14 have been determined to have occurred, no unsafe conditions violative of N.J.A.C. 5:23-2.32a have been found and there are no other violations of the Construction Code applicable thereto.

Application for a certificate of occupancy shall be made on forms provided by the office of the Construction Official and payment of a fee in the amount of $50 in the case of a dwelling and $100 in the case of any other structure or building shall be required.

Any person, firm or corporation violating any provisions of this chapter shall, upon conviction, be subject to a fine not exceeding $1,000, a term of imprisonment not exceeding 90 days or a period of community service not exceeding 90 days, or any combination thereof, in the discretion of the Judge.
