The Mayor, with the approval of a majority of
the total number of Council, shall appoint a legal advisor for an
indefinite period. The legal advisor shall be a person or a firm of
the persons licensed to practice law in the Commonwealth. The Mayor
may remove the legal advisor at any time, with or without cause, with
thirty (30) days written notice, with the approval of a majority vote
of the total number of Council members.
The legal advisor shall be the chief legal officer
of the municipality and shall furnish legal advice to the Mayor, to
the Council, and to officers, boards, and commissions concerning any
matter arising in connection with the exercise of their official powers
and duties. The legal advisor shall have the right to access to the
records of any officer, department, board, or commission of the municipality
as necessary in the performance of his duties.
Neither the Mayor nor any member of Council
or employee of any department, agency, or authority shall serve as
legal advisor. The legal advisor shall not serve as legal counsel
for any authority of the municipal government.
