From and after the passage of this article, the Council of the Borough
of Baden shall levy, assess and collect in advance all fees and costs necessary
to completely offset and defray the entire cost of any hearing on any appeal,
request, proceeding or application requested by or filed by any party under
any law, statute, ordinance or regulation providing for a hearing to be granted
any person by the Borough of Baden or any subdivision or department thereof.
The Council of the Borough of Baden shall set, reset and adjust, increase,
decrease, change and otherwise modify any fee from time to time by resolution
so as to ensure that the Borough and its taxpayers are saved harmless from
incurring any cost or expense for or on account of any person, firm, individual,
corporation or political subdivision being afforded a hearing of any kind.
All fees and costs set by the Council by resolution under this article
shall be in such amounts as to completely defray the administrative costs
and expenses of providing said hearing, including any fees charged by an employee
or independent contractor hired by the Borough to perform services in connection
with such a hearing or proceeding. These expenses shall include but not be
limited to fees and costs charged by court stenographers, hearing examiners,
engineers or other experts necessarily employed in the conduct of such a hearing
or proceeding requested.
This article and concomitant resolutions shall be applicable to all
appeals, hearings and proceedings requested under any state, federal, local
law or Borough ordinance requiring or providing for a hearing to be held by
the Borough or any of its subdivisions.
The Borough of Baden its employees, agents and servants shall be authorized
hereunder to refuse to accept any application, appeal, request or other documents
or communication seeking a hearing or proceeding unless and until the proper
fee accompanies said request or communication.
