There is hereby created within the Police Department of the Municipality
of Kingston an agency to be known as the "Educational Service Agency."
All persons employed as school crossing guards by the Municipality of
Kingston shall be considered to be employed in and by the municipality's
Educational Service Agency.
The Educational Service Agency herein established shall be under the
direction and control of the Chief of Police of the Municipality of Kingston,
who shall designate a regular police officer or other similarly authorized
official of the municipality to serve as Safety Patrol Officer.
It shall be the duty of the Safety Patrol Officer to supervise and direct
the work of the Educational Service Agency.
Persons employed or to become employed in and by the Educational Service
Agency shall not be considered to be regular employees of the Police Department
of the Municipality of Kingston.
Persons employed or to become employed in and by the Educational Service
Agency shall perform no services other than services to the Wyoming Valley
West School District, through the provision of protection of students at intersections
within the corporate limits of the Municipality of Kingston.
This chapter shall in no way affect the employment rights, duties or
obligations of any person, but shall be considered to constitute a statement
of clarification of the employment status of persons employed or to become
employed hereafter as school crossing guards.
The Educational Service Agency hereby recognized and formally established
shall continue until changed or abolished by action of the Municipal Council
of the Municipality of Kingston, or until the suspension of Act 108 of 1979,
as heretofore adopted by the Legislature of the Commonwealth of Pennsylvania
in accordance with the terms thereof.
The Municipality of Kingston, acting by and through its Municipal Council,
may, as required from time to time hereafter, enact by further resolution
or ordinance, if required, any additional regulations or requirements necessary
in order to ensure that the Educational Service Agency created by this resolution
shall and will be at all times in conformity with Act 108 of 1979, and any
subsequent court decisions interpreting the same.
