A.
Municipal and public purposes.
(1)
Upon the adoption of this article in accordance with the laws of the State of New Jersey, a portion of the current balance of the water allocation to the City of Vineland shall be set aside for municipal and public purposes. That amount shall be 31,000,000 gallons per year.
(2)
Upon the receipt of any new allocation amount granted to the City of Vineland by the NJDEP, a portion of that new allocation shall be set aside for municipal and public purposes. That amount shall be 31,000,000 gallons per year.
(3)
For purposes of this section, "municipal and public purposes" shall mean the expansion, addition or construction of municipal buildings, parks and the like in which water allocation is necessary, public or private schools, colleges and educational institutions, any redevelopment project within designated redevelopment areas or federal empowerment zone or the Urban Enterprise Zone.
(4)
Distribution of allocation reserved for municipal and public purposes shall be in accordance with the ranking of projects as is hereinafter set forth unless otherwise determined by City Council after a public hearing.
(5)
Distribution of the reserved allocation for municipal and public purposes shall be utilized only after the exhaustion of existing allocation distributed in accordance herewith.
B.
Industrial/commercial and residential.
(1)
Based upon a review of the ten-year history of industrial/commercial and residential water use in the City of Vineland, industrial/commercial accounts for 52% thereof and residential accounts for 48% thereof. As such and based thereon, the net remaining allocation, after deducting that amount set aside for municipal and public purposes, shall be divided with 52% reserved for industrial/commercial projects and 48% reserved for residential projects.
