A. 
Municipal and public purposes.
(1) 
Upon the adoption of this article in accordance with the laws of the State of New Jersey, a portion of the current balance of the water allocation to the City of Vineland shall be set aside for municipal and public purposes. That amount shall be 31,000,000 gallons per year.
(2) 
Upon the receipt of any new allocation amount granted to the City of Vineland by the NJDEP, a portion of that new allocation shall be set aside for municipal and public purposes. That amount shall be 31,000,000 gallons per year.
(3) 
For purposes of this section, "municipal and public purposes" shall mean the expansion, addition or construction of municipal buildings, parks and the like in which water allocation is necessary, public or private schools, colleges and educational institutions, any redevelopment project within designated redevelopment areas or federal empowerment zone or the Urban Enterprise Zone.
(4) 
Distribution of allocation reserved for municipal and public purposes shall be in accordance with the ranking of projects as is hereinafter set forth unless otherwise determined by City Council after a public hearing.
(5) 
Distribution of the reserved allocation for municipal and public purposes shall be utilized only after the exhaustion of existing allocation distributed in accordance herewith.
B. 
Industrial/commercial and residential.
(1) 
Based upon a review of the ten-year history of industrial/commercial and residential water use in the City of Vineland, industrial/commercial accounts for 52% thereof and residential accounts for 48% thereof. As such and based thereon, the net remaining allocation, after deducting that amount set aside for municipal and public purposes, shall be divided with 52% reserved for industrial/commercial projects and 48% reserved for residential projects.
A. 
The following point system and procedure shall determine the order upon which a project shall be granted requested allocation:
(1) 
Planning/Zoning Board approval.
(a) 
Upon receipt of preliminary Planning/Zoning Board approval, an applicant project will receive a total of five points.
(b) 
Upon receipt of final Planning/Zoning Board approval, an applicant project will receive a total of 15 points.
(c) 
If no Planning/Zoning Board approval is required, an applicant project will receive a total of 20 points upon the issuance of a zoning permit.
(d) 
If no zoning permit is required, an applicant project shall receive a total of 20 points.
(2) 
Sewer/septic approval.
(a) 
Upon receipt of preliminary sewer approvals as defined by the Landis Sewerage Authority (LSA), an applicant project will receive a total of two points.
(b) 
Upon receipt of a fully executed allocation agreement between the LSA and the applicant and the payment of all fees required by the LSA, an applicant project will receive a total of eight points.
(c) 
For purposes of this subsection, all residential projects approved with septic systems shall automatically receive a total of 10 points.
(3) 
City of Vineland Water Utility approvals.
(a) 
Upon completion of preliminary review by the City of Vineland Water Utility, an applicant project shall receive a total of two points.
(b) 
Upon the adoption of a resolution by the City Council of the City of Vineland authorizing the Superintendent of the Water Utility to execute a water allocation permit application and the payment of all water connection fees, the applicant shall receive eight points.
(c) 
For purposes of this subsection; no application for City of Vineland Water Utility preliminary review shall be considered until the project application is deemed complete and all fees have been paid for preliminary site plan/subdivision approval.
B. 
The applicant shall be responsible to provide proof of compliance with Subsection A herein to the Superintendent of the Water Utility.
A. 
All water allocation previously reserved in accordance with this article shall expire on the three-year anniversary of the date upon which the applicant project attained 40 points pursuant to this article unless the applicant project has recorded the final plat in the Clerk's Office of the County of Cumberland, New Jersey. Water allocation previously reserved in accordance with this article shall also expire upon cancellation by the applicant.
B. 
No municipal or public purposes project shall be subject to the recision of reservation of allocation except by ordinance of the City Council of the City of Vineland.
A. 
There shall be created a Water Allocation Review Committee (hereinafter referred to as WARC), whose purpose is to review and make recommendations to the City Council of the City of Vineland regarding the distribution or redistribution of allocation set aside for the three use groups, residential, commercial/industrial and municipal and public purposes. The WARC shall make recommendations to Council regarding the percentage of distribution of allocation among said uses whenever the City of Vineland receives any new allocation by the NJDEP. Further, in the event water allocated to any use group is reasonably anticipated to be depleted based upon approved allocations, the distribution as set forth herein shall be reviewed by the WARC. The WARC shall recommend any redistribution of water allocation to City Council. City Council shall consider any recommendation after a public hearing duly advertised in accordance with the procedures of the adoption of a municipal ordinance.
B. 
The Water Allocation Review Committee shall consist of the following officers of the City of Vineland: City Planner; City Engineer; Superintendent/Manager of Public Works; Director of Economic Development; Business Administrator; Superintendent of the Water Utility; City Solicitor; and City Council Liaison to the Water Utility.
