For the purpose of this chapter, certain words
and terms used herein are defined as follows:
BUSINESS STREET
A street which serves or is designed to serve as an access
to abutting business properties.
CONDITIONAL APPROVAL OF THE FINAL PLAT
The approval by the Planning Board of a final plat subject
to conditions set forth by the Planning Board in a resolution conditionally
approving such plat. Such conditional approval does not qualify a
final plat for recording nor authorize issuance of any building permits
prior to the signing of the plat by a duly authorized officer of the
Planning Board and recording of the plat in the office of the County
Clerk or register as herein provided.

DEAD-END STREET
A street or a portion of a street with only one vehicular
outlet.
EASEMENT
Authorization by a property owner for the use by another,
and for a specified purpose, of any designated part of his property.
FINAL PLAT
A drawing or drawings that show a proposed subdivision, containing
in such additional detail as required by the Planning Board all information
required to be shown on a preliminary plat and the modifications,
if any, required by the Planning Board at the time of approval of
the preliminary plat if such preliminary plat has been so approved.

FINAL PLAT APPROVAL
The signing of a plat in final form by a duly authorized
officer of a Planning Board pursuant to a Planning Board resolution
granting final approval to the plat or after conditions specified
in a resolution granting conditional approval of the plat are completed.
Such final approval qualifies the plat for recording in the office
of the County Clerk.

MINOR STREET
A street intended to serve primarily as an access to abutting
residential properties.
OFFICIAL MAP
The map, if any, established by the Town Board under § 270
of the Town Law, showing the streets, highways and parks heretofore
laid out, adopted and established by law, and any amendments thereto
adopted by the Town Board or additions thereto resulting from the
approval of subdivision plats by the Planning Board and the subsequent
filing of such approved plats.
OFFICIAL SUBMISSION DATE
The date when a subdivision plat shall be considered submitted to the Planning Board, as provided in § 276 of the Town Law, and is hereby defined to be the date of a meeting of the Planning Board at which all required surveys, plans and data described in Article
IV are submitted.
PRELIMINARY PLAT APPROVAL
The approval of the layout of a proposed subdivision as set
forth in a preliminary plat but subject to the approval of the plat
in final form in accordance with the provisions of this section.

SECONDARY STREET
A street which serves or is designed to serve as a route
connecting different parts of the Town and is so designated on the
Town Comprehensive Plan, if any.

STREET
Includes streets, roads, avenues, lanes or other ways.
STREET PAVEMENT
The wearing or exposed surface of the roadway used by vehicular
traffic.
SUBDIVIDER
Any person or entity who shall lay out, for the purpose of
sale or development, any subdivision or part thereof, as defined herein,
either for himself or others.
SUBDIVISION
A division of any parcel or tract of land which will result
in any of the following:

A.
New or extended public streets, private streets
or rights-of-way of access.
B.
An increase in the number of legal or equitable
property owners entitled to use private streets or rights-of-way of
access.
C.
An extension of municipal services such as water,
sewer or year-round road maintenance.
D.
The preparation and filing of County Health
Department approved subdivision plans as required by New York State
Public Health Law, Article 11, Title II.
TOWN COMPREHENSIVE PLAN
A comprehensive plan for development of the Town, if any,
prepared by the Planning Board, pursuant to § 272-a of the
Town Law, which plan indicates the general locations recommended for
various public works and reservations and for the general physical
development of the Town, and includes any part of such plan separately
adopted and any amendment to such plan or parts thereof.
TRACT
Any body of land, including contiguous parcels of land, under
one ownership or under a common control of any group of persons acting
in concert as part of a common scheme or plan. NOTE: The preceding
definition of "tract" is identical to the definition of "tract" contained
in § 1115(2) of the New York State Public Health Law.

ZONING ORDINANCE
The officially adopted Zoning Ordinance of the Town, together
with any and all amendments thereto.
