The Town Board shall appoint a Land Use Inspector to carry out the duties assigned to that position by this chapter. Those duties are more particularly defined as follows:
A. 
To approve those site plan permits not subject to Planning Board review.
B. 
To conduct site and construction inspections to ensure that regulated work is progressing in accordance with the terms of the permit.
C. 
To issue or deny certificates of occupancy.
D. 
To file all matters of record pertaining to permit application in the office of the Town Clerk or other suitable public office.
E. 
To coordinate with other agencies and officials as appropriate.
F. 
To attend Town Board and Planning Board meetings as is deemed necessary to report the status of to-date permit issuance.
G. 
To carry out other duties as may be designated by local law or by resolution of the Town Board.
The Town Board may amend, supplement or change this chapter after referral to and recommendation of the Planning Board and after public hearing.

Exceptions to the provisions of this chapter may be made at the discretion of the Planning Board only upon unanimous vote when it has been clearly shown and demonstrated unequivocally and beyond doubt by the petitioner that an extremely unusual circumstance and/or barrier to compliance exists which was unknown to exist prior to the petitioner's commitment to the project and it appears that, in the best interests of the community, an exception should be made.
Any person aggrieved by any decision of the Planning Board or any officer, department, board or bureau of the town may apply to the Supreme Court for a review by a proceeding under Article 78 of the Civil Practice Law and Rules. Such proceedings shall be instituted within thirty (30) days after the filing of a decision in the office of the Town Clerk.
A. 
Any person, firm or corporation who commits an offense against, disobeys, neglects or refuses to comply with or resists the enforcement of any of the provisions of this chapter shall, upon conviction, be deemed guilty of a violation, punishable by a fine of not more than two hundred fifty dollars ($250.) or by imprisonment for not exceeding six (6) months, or by both such fine and imprisonment. Each week an offense is continued shall be deemed a separate violation of this chapter.
B. 
In addition to the penalties provided above, the Town Board may also maintain an action or proceeding in the name of the town in a court of competent jurisdiction to compel compliance with or to restrain by injunction the violation of this chapter.
