The purpose of this chapter is to establish penalties for repetitive false alarms from remote automatic alarms, and to attempt to minimize the number of false alarms generated by these remote automatic alarms, thereby promoting the health, welfare and safety of the residents of the Town of Naples.
As used in this chapter, the following terms shall have the meanings indicated:
FALSE ALARM
Any alarm or signal generated by a remote automatic alarm and transmitted to a receiver maintained by the Maxfield Hose Co., Inc., or by any state or local government or any subdivision or agency thereof and which was not generated in response to actual fire, smoke or the presence of an intruder.
INTRUDER
Any individual who enters in or upon premises when he is not licensed or privileged to do so.
REMOTE AUTOMATIC ALARM
Any device installed in or on any structure for the purpose of detecting the presence of an intruder or of smoke or fire and which is capable of communicating an alarm or signal by electronic, telephonic or other means to a receiver maintained by the Maxfield Hose Co., Inc., or by any state or local government or by any agency or subdivision thereof.
A. 
In the event the Maxfield Hose Co., Inc., or any of its officers or agents, and/or any peace officer as that term is defined by the laws of the State of New York, shall respond to three separate false alarms generated by any single remote automatic alarm located in the Town of Naples, outside the geographical limits of the Village of Naples, the owner of the premises containing such remote automatic alarm shall be subject to a civil penalty of $100.
B. 
Upon a fourth such false alarm, the owner of the premises shall be subject to a civil penalty of $200.
C. 
Upon a fifth or subsequent such false alarm, the owner of the premises shall be subject to a civil penalty of $250.
Notwithstanding the above, the term "false alarm" shall not mean an alarm purposely generated by the owner of a structure for purposes of testing the effectiveness of said alarm, provided that the Maxfield Hose Co., Inc., and the Ontario County Sheriff shall have first been given five days' written notice of the date, time and location such test shall occur.
