The Planning Board of the Town of Naples is
authorized and empowered to approve plats showing lots, blocks, or
sites, with or without streets or highways, to approve the development
of entirely or partially undeveloped plats already filed in the office
of the Ontario County Clerk, and to approve preliminary plats with
or without modifications within that part of the Town of Naples outside
the limits of any incorporated village.
It is declared to be the policy of the Planning
Board to consider land subdivision plats as part of a plan for the
orderly, efficient and economical development of the town. This means,
among other things, that land to be subdivided shall be of such character
that it can be used safely for building purposes without danger to
health, or peril from fire, flood or other menace; that proper provision
shall be made for drainage, erosion control, water supply, sewerage
and other needed improvements; that all proposed lots and improvements
therein shall be so laid out and of such size as to be in harmony
with the development pattern of the neighboring properties; that the
proposed streets shall compose a convenient system conforming to the
Official Map, if such exists, and shall be properly related to the
proposals shown on the Comprehensive Plan, and shall be of such width,
grade and location as to accommodate the prospective traffic, to facilitate
fire protection and to provide access of fire-fighting equipment to
buildings; and that proper provision shall be made for open spaces
for parks and playgrounds.
In order that land subdivision shall be made
in accordance with this policy, these regulations, which shall be
known and cited as the "Subdivision Regulations of the Town of Naples,"
have been adopted by the Naples Town Board.

The Planning Board has been granted authority to permit cluster
development pursuant to Town Law § 278 and subject to the
applicable provisions of the Zoning Chapter of the Code of the Town
of Naples.
The Town Planning Board has been granted the
authority to review plats already filed in the office of the Clerk
of Ontario County if such plats are entirely or partially undeveloped
as provided in § 276 of the Town Law of the State of New
York, by resolution of the Naples Town Board adopted on the eighth
day of February 1993. Said plats shall be reviewed in accordance with
this chapter of the Code of the Town of Naples. Only plats where 20%
or more of the lots are undeveloped shall be subject to reconsideration
under this section. Reconsideration shall be commenced upon a majority
vote of the Town Planning Board at a regularly scheduled meeting of
the Board. Any resident, officer, or duly established board of the
town may initiate a request for reconsideration which shall be voted
upon by the Town Planning Board.
