There shall be a Board of Health consisting of three members, each elected for a three-year term, who shall choose a chairman and shall act by majority vote. (Charter § C-2.07A)
The Board of Health shall have all of the powers and duties conferred upon it by the Charter, the Town bylaws, votes of Town Meetings, and the General Laws of the Commonwealth. (Charter § C-2.07B)
The Board of Health shall appoint a Health Agent, who shall serve at the pleasure of the Board. The duties of the Health Agent shall be such as may be legally conferred upon him by the Board, as well as those that are conferred upon him by the General Laws of the Commonwealth. (Charter § C-2.07C)
In the event of public health emergency, as declared by a majority of the members of the Board of Health, the provisions of § 104-2C of Chapter 104, Officers and Employees, Article I, Town Officials, shall not be deemed to apply. (Charter § C-2.07D)
It shall be the duty of the Board of Health to look
after the sanitary condition of the Town. They shall make such regulations
as they judge necessary for the public health and safety respecting
nuisances, sources of filth, and causes of sickness within the Town,
and respecting articles that are capable of containing infection and
contagion that might be brought into or conveyed from the Town; and
to enter complaint against all persons offending against the laws
of this Commonwealth regarding health, or their regulations, and to
prosecute the same to a final judgment.
