There is hereby established in the government
of the City of Vineland a Department which shall be known as the "Department
of Public Works."

Within the Department of Public Works shall
be allocated and assigned the Division of Engineering and the Division
of Public Works. Within the Division of Public Works shall be allocated
and assigned the subdivisions of Streets, Roads and Sanitation, Street
Marking and Traffic Signs, Public Property, Recreation, Solid Waste
Management, Equipment Maintenance and Vehicle Fuel Facility, and the
subdivision of Tree Cultivation and Maintenance. Within the Division
of Engineering shall be allocated and assigned subdivisions of Engineering
and Planning.
There is hereby assigned and transferred to
said Department all the subordinate officers and employees in the
City of Vineland holding their offices and positions under tenure
of office under any law of this state or Title 11A (Civil Service)
of the Revised Statutes of New Jersey and now exercising and performing
any of the functions, powers and duties as heretofore. Nothing herein
contained shall be construed to affect or impair the tenure of office,
civil service or pension rights of any of the officers and employees
transferred to said Department.
There is hereby transferred and assigned to
said Department all of the property, books, papers and records relating
to any of the offices and other governmental agencies hereinabove
allocated and assigned to said Department, except such books, papers
and records as are now required by law or the ordinances of the City
of Vineland to be kept in the office of some other officer or department
of the City government.

A. There is hereby created the office of Director of Department of Public
Works. The Director shall be appointed by the Mayor of the City of
Vineland with the advice and consent of City Council of the City of
Vineland, pursuant to N.J.S.A. 40:69A-32, and shall serve only during
the term of office of the Mayor appointing him or her and until the
appointment and qualification of his/her successor and shall be subject
to removal as provided by law. Vacancies in the office of Director
shall be filled in the same manner as the original appointment but
for the unexpired term only.
B. Salary and time. The Director shall receive an annual salary to be
paid in a manner as other department heads and officers of the City
of Vineland. The Director's salary range shall be between $104,762
and $130,000 per annum. The position of Director of the Department
of Public Works shall be considered a full-time management position
and exempt from the federal Fair Labor Standards Act to the extent
that no overtime shall be afforded to said Director.

C. Qualifications. The Director shall also possess a general knowledge
of road networks, drainage systems, street marking and traffic control
devices and heavy equipment maintenance. The Director shall also possess
a general knowledge of the public buildings and grounds, parks and
parking lots in the City of Vineland and shall possess good public
relation skills, good organizational skills and experience with human
resources program planning and budgeting.
D. Powers and duties of Director. The Director shall have general administrative
authority over the Department of Public Works. In addition to the
functions, powers and duties that are hereby or may hereafter be conferred
and imposed upon him by law and the ordinances of the City, the Director
shall:
(1) Approve the appointment of the subordinate officers and employees
of the Division of Engineering with the advice and consent of the
City Engineer.
(2) Approve the appointment of subordinate officers and employees of
the Division of Public Works with the advice and consent of the Superintendent
of Public Works.
(3) Approve or disapprove payrolls, bills and claims chargeable to the
Department appropriation.
(4) Provide such informational reports on the work of the Department
as may from time to time be required by the Mayor.
(5) Establish policies and procedures for the administration of divisional
activities.
(6) Be responsible for all financial and budgetary matters of the Department.
(7) Perform such other duties as directed by the Mayor.

A. Superintendent of Public Works. There is hereby created
the position of Superintendent of Public Works pursuant to N.J.S.A.
40A:9-154.6a et seq. The Superintendent of Public Works shall be the
supervisor of the Division of Public Works and shall be directly responsible
to advise the Director of Public Works and other municipal elected
officials and employees in the proper compliance and administration
of various laws, regulations, technical practices, operations and
management techniques with regards to the Division of Public Works
and related activities conducted by the municipality.
B. Salary. The Superintendent of Public Works shall receive
an annual salary to be paid in the same manner as salaries of all
other City employees with a salary range as set forth in Ordinance
No. 8 and amendments thereto. The position of Superintendent of Public
Works shall be considered full-time.
C. Qualifications. The Superintendent of Public Works shall be a certified public works manager, as defined by N.J.S.A. 40A:9-154.6(g). The Superintendent of Public Works shall also be subject to the residency requirements of municipal Ordinance No. 94-09, Chapter
151 of the Code of the City of Vineland. The Superintendent of Public Works shall also possess a thorough knowledge of road networks, drainage systems, street marking and traffic control devices, heavy equipment maintenance and operation and local public contracts law. The Superintendent of Public Works shall also have the ability to efficiently organize and schedule work to give clear assignments and instructions to groups and individuals, to prepare suitable reports and to keep needed records and files.
D. Powers and duties of the Superintendent of Public
Works. The Superintendent of Public Works shall, in addition to the
functions, powers and duties that are hereby or may hereafter be conferred
and imposed upon him/her by law and the ordinances of the City of
Vineland, pursuant to the policies adopted by the Director:
(1) Direct the operation of the Division of Public Works,
including the activities of the staff, and coordinate all the work
and activities of the aforesaid subdivisions.
(2) Report, at least monthly, to the Director in such
form as shall be prescribed by the Director on the operation of the
Department during the preceding month and make such other reports
as may be requested by the Director.
(3) Assist in executing plans for the effective utilization
of available funds, personnel, equipment, materials and supplies.
(4) Organize and develop suitable work programs for the
varied functions of the Division.
(5) Give suitable assignments and instructions to individuals
and groups and supervise their work.
(6) Make investigations of complaints and take proper
action to see that needed repairs are made with a minimum delay.
(7) Inspect and check work in progress or completed to
see that proper procedures are followed.
(8) Keep needed records and files and prepare suitable
reports.
(9) Prepare and obtain approval and implement a capital
improvement program for the City's infrastructure in coordination
with the City Engineer, the Planning Board of Adjustment and the Business
Administrator related to the Division of Public Works and its subdivisions.
(10)
Prepare and assist in the preparation of loan
and grant applications to state and federal government agencies for
City projects and inform the Director of Public Works, the Mayor and
City Council of all available financial aid.
(11)
Provide technical assistance, labor and equipment
to other divisions within the Department as expeditiously as possible
based upon the priority of the assistance needed by the other divisions.

A. Subdivision established. Within the Division of Public
Works there shall be a Subdivision of Streets, Roads and Sanitation.
B. Functions of the Subdivision. Under the direct supervision
of the Superintendent of Public Works, the Subdivision of Streets,
Roads and Sanitation shall:
(1) Maintain and repair all City streets and roads, culverts
and drains.
(2) Undertake and administer road construction projects
and road surfacing and resurfacing projects which are to be performed
by Division personnel.
(3) Provide for the cleaning of streets, roads, City-owned
and City-leased parking lots, culverts and drains.
(4) Clear snow and ice from the streets and City-owned
and City-leased parking lots and provide any other street services
as may be necessary for the safe and efficient operation of traffic.
(5) Assign appropriate and trained operators and equipment
to provide regular and periodic inspections of the drainage system
and to clear the drainage system of any obstructions to provide for
proper drainage of road surface water to ensure safe passage over
the municipality's road network.
(6) Enforce the provisions of Vineland Code Chapter
320, Drainage Systems.
(7) Provide for compliance with federal, state and any
other regulations pertaining to stormwater discharge.
(8) Collect leaves gathered and deposited by private owners
on or along the public streets in the manner set forth in rules and
regulations established by the City Engineer and on file with the
City Clerk.
(9) Be responsible for the control of obnoxious growths,
trash and debris on vacant City-owned properties.
(10)
Where directed by the City Engineer, the Director
of Health or their designees, in accordance with established policies
and procedures, provide for the cutting of brush and hedges or the
removal of obnoxious growths, trash and debris on privately owned
properties at the expense of the owner.

Maintain the municipal landfill and composting
facilities under the supervision of the City Engineer.

A. Subdivision established. Within the Division of Public
Works, there shall be a Subdivision of Public Property.
B. There shall be created the position of Manager of
Public Property.
C. Functions of the Subdivision. Under the direct supervision
of the Manager of Public Property and the general supervision of the
Superintendent of Public Works, the Subdivision of Public Property
shall:
(2) Provide custodial and janitorial services for all
City-owned and City-leased buildings.
(3) Maintain and landscape City grounds and parks, including
parking lots owned or leased by the City.
(4) Maintain and landscape grounds surrounding City-owned
or City-leased buildings.
(5) Provide equipment and facilities for parades and events
and supervise post-parade event maintenance.
(6) Maintain public playground equipment and recreational
facilities, including the preparation of sports fields and courts
in coordination with the Recreation Division.
(7) Assist the Recreation Commission in the development
of parks and playgrounds.
(8) Operate and maintain the municipality-owned trolley
in accordance with the regulations governing the use of said trolley
and its area of operation.

A. Subdivision established. Within the Division of Public Works there
shall be a Subdivision of Solid Waste Management.
B. Functions of the Subdivision. Under the direct supervision of the
Assistant Director of Solid Waste Management and the general supervision
of the Superintendent of Public Works, the Subdivision of Solid Waste
Management shall:
(1) Enforce the provisions of Chapter
620 of the Vineland City Code in accordance with established rules and regulations on file with the City Clerk and in accordance with the County of Cumberland Solid Waste Management Plan.
(2) Implement recycling programs and procedures established by the City
of Vineland.
(3) Provide, operate and maintain facilities for collection and disposal
of solid waste, including but not limited to licensed composting sites
and postclosure maintenance of the municipal landfill.
(4) Prepare and assist in the preparation of loans and grant applications
to state and federal government agencies for City projects and inform
the Director of Public Works, the Mayor and City Council of all available
financial aid.
The following ordinances are hereby repealed:
