A.
The applicant shall pay for all engineer's fees and legal fees incurred by the Town of Richmond in review of any major subdivision project submitted for approval, including but not limited to fees associated with environmental review of any project for subdivision of any parcel of land and fees associated with an application for rezoning and/or subdividing any parcel. Payment of such fees shall be a condition of such application and paid for by the applicant prior to final filing of any resolution approving the rezoning, subdivision and/or amending of the town map or within 90 days of any final disposition of the application, whichever is sooner.
B.
The applicant shall pay for all engineering fees and legal fees associated with an application for major subdivision approval as follows:
(1)
For concept approval: together with the preliminary subdivision approval or within 90 days of the application for concept approval, whichever is sooner.
(2)
For preliminary subdivision approval: together with the application for final subdivision approval or within 90 days of the disposition of the application for preliminary subdivision approval, whichever is sooner.
(3)
For final subdivision approval: prior to signature of the final subdivision plat by the Chairman of the Planning Board or within 90 days of the disposition of the application for final subdivision approval, whichever is sooner.
C.
Payment for engineer's fees and legal fees shall be charged to and paid by the applicant prior to issuance of any certificate of occupancy or within 90 days of final disposition of the application, whichever is sooner.
D.
Payment for reasonable and necessary engineering and legal costs associated with any major subdivision project shall be made by the applicant. Pursuant to Chapter 27 (Fees Reimbursement) of the Town Code, and in accordance with the fee schedule then in effect, estimated review fees shall be paid to the Town Clerk, in the form of a certified check made payable to the Town of Richmond. Upon receipt, the Town Clerk shall cause such monies to be placed in a separate noninterest-bearing account in the name of the Town and shall keep a separate record of all such monies deposited and the name of the applicant and project for which such sums were deposited.

E.
Any fees charged in accordance with this article which are not paid may result in penalties subject to applicable provisions of Chapter 27 of the Town Code. Any application filed herein shall constitute a consent and authority to such action and shall be signed by the owner of record of the subject parcel.

F.
Application fee. The application fee for major subdivisions shall be established by the Town Board.
