The Board of Trustees finds that the placement for prolonged periods of time of rubbish, garbage, recyclables, waste material, disposable items and other items for disposition and removal upon or adjacent to the right-of-way creates a health and safety hazard. At times, such items are placed upon or adjacent to the Village right-of-way for days prior to a collection day thereby creating a lack of visibility for drivers utilizing adjacent roadways, health hazards as such items decompose, and a safety hazard by providing prowlers with an area away from plain view and creating an aesthetically displeasing sight. To eliminate these hazards to the public health, safety and welfare, the Board of Trustees has enacted this article governing the disposing, removing, storing and placement of rubbish, garbage, recyclables, waste material, and other disposable items as well as permitting the Board of Trustees to establish regulations governing such in the future.
A. 
It shall be unlawful for any person to take, remove, collect or in any manner interfere with or disturb any papers, rubbish, garbage, refuse, ashes, recyclables or other waste matter or disposable items deposited outside of any dwelling, business place or other premises within the boundaries of the Incorporated Village of Roslyn Harbor which have been set out for the purpose of having the same collected and removed. All such items shall be collected and removed only by a licensed carter.
B. 
No person shall dump or throw, or cause to be dumped or thrown, any garbage, rubbish, ashes, clippings, refuse, tin cans, recyclables, waste material, disposable material or discarded matter of any kind or description upon any street, road, avenue, highway or public or private land within the Incorporated Village of Roslyn Harbor.
C. 
It shall be unlawful for any person to set out any rubbish, garbage, refuse, ashes, recyclables, waste matter, discarded matter or other disposable items prior to 6:00 p.m. of the day before the regularly scheduled collection and removal of such items.

Any person, association, firm or corporation who or which violates any provision of this article or assists in the violation of any provision of this article shall be guilty of a violation, punishable as provided in Chapter 1, Article I of this Code. Each week's continued violation shall constitute a separate additional violation.
