These regulations shall be deemed the minimum requirements for the future growth and development of the Village which will provide adequate facilities for the housing, transportation, distribution, comfort, convenience, safety, health and welfare of its population.
A. 
Special circumstances; hardship. Where the Board finds that because of special circumstances of a particular plat, extraordinary hardships, not of the owner's or subdivider's making, may result from strict compliance with these regulations, it may vary or waive any of the requirements of the regulations so that substantial justice may be done and the public interest secured, provided that such variation or waiver shall not have the effect of nullifying the intent or purpose of Chapter 275, Zoning, or the Official Map, or the Master Plan, if any, or of these regulations.
B. 
Conditions. In granting any variance or waiver, the Board shall set forth in its resolution of approval such conditions as will substantially secure the objectives of Chapter 275, Zoning, the Official Map, the Master Plan, if any, and of these regulations.

Any person, firm, or corporation who or which shall violate any of these regulations or any conditions imposed by the Planning Board pursuant to § 232-10H or 232-55B hereof, or any other condition or restriction required or imposed by resolution of the Planning Board in connection with the subdivision or development of any parcel of land in the Village, shall be subject to prosecution and to penalties in the same manner and to the same extent as if such violation were a violation of Chapter 275, Zoning, of the Village Code. A breach of any such regulation, condition or restriction which is of a continuing nature and which was in existence on January 1, 1971, shall not be deemed a violation until 30 days after notice by the Building Official that such breach must be discontinued.
