It is hereby declared the policy of the Board of Trustees of the Incorporated Village of Roslyn Harbor to eliminate the unsightly parking of vehicles in front or side yards of residences in areas not planned for the parking of vehicles. Haphazard parking of vehicles creates aesthetic unpleasantness and can lead to a deterioration of property values.
The parking of any vehicle on residential property other than on a driveway or in a garage is prohibited.
For purposes of this article, the following words shall have the following meanings:
PARKING
Leaving a vehicle unoccupied and standing motionless and unattended for an interval of time longer than necessary to board or unload passengers or freight.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, off highway, trails or snow, except devices propelled by muscular power and electrically driven mobility assistant devices operated or driven by a person with a disability.
Anything herein to the contrary notwithstanding, exemption to the prohibition contained herein may be granted upon demonstration that the exemption sought is not injurious to the public health and welfare, by issuance, for a period not to exceed 30 days, of a certificate of exemption by application of the property owner to the Village Clerk of the Incorporated Village of Roslyn Harbor. No such certificate shall be granted or renewed more than three times in each calendar year.
Any person violating any of the provisions of this article shall pay a penalty as provided in Chapter 1, Article I of this Code. It shall be deemed a new or additional offense for every twenty-four-hour period during which the condition continues unabated, provided that a new accusatory instrument is issued.
