The owner of a dog or other animal shall not permit such dog or other animal to create a nuisance within the Township by such animal's excessive barking, howling or other similar sound.
A. 
Any person objecting to such excessive barking, howling or other similar sound by a dog or other animal may file a signed complaint against the owner of the animal with the Township Animal Control Officer.
B. 
In the event that five or more complaints are filed by five or more different individuals against one owner during a period of 60 days or less, the Animal Control Officer shall refer the matter to the Magisterial District Judge for disposition.

Any person, firm or corporation who shall violate any provision of this article, upon conviction thereof in an action brought before a Magisterial District Judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000, plus costs, and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this article continues or each section of this article which shall be found to have been violated shall constitute a separate offense.
