This chapter restating and amending Ordinance No. 67, as amended, is adopted by authority of and pursuant to the provisions of the Pennsylvania Municipalities Planning Code, Act 247 of 1968, as amended by Act 170 of 1988 and all subsequent amendments. [1]

This chapter has been designed and adopted to provide uniform standards and procedures for the regulation and control of subdivision and land development within the Township of West Deer. The purpose of such regulation and control is to provide for the safe and coordinated development of the Township by assuring the availability of sites suitable for building purposes and human habitation, by coordinating proposed streets and other proposed public improvements with those existing, by assuring that adequate easements and rights-of-way are provided for drainage facilities and the extension of public utilities and by assuring that any reservation of land for public use shall be suitable in size and location for the use intended. This chapter is designed to protect the natural resources of the Township and to promote public health, safety and general welfare.
A. 
The authority to receive, review and recommend subdivision and land development approval pursuant to this chapter and to otherwise administer the provisions herein shall be assigned to the West Deer Township Planning Commission by the Board of Supervisors.
B. 
All applications for subdivision and land development located within the Township shall be forwarded upon receipt by the Planning Commission Secretary to the Township Planning Commission for review and recommendation to the Township Supervisors.
No landowner shall subdivide, resubdivide or propose a land development or lay out, construct, open or dedicate any street, sewer, water main or other improvement for public use, travel or other purpose or for the common use of occupants of buildings abutting thereon or sell, transfer, or enter into an agreement to sell any land in a subdivision or land development located in the Township, whether by reference to or by other use of a plat of such, or erect any building thereon unless and until a final plat has been prepared in full compliance with the provisions of this chapter, where applicable, and such has been finally approved and recorded as provided herein.
The provisions set forth herein shall be held to be the minimum requirements necessary to meet the stated purpose of this chapter and the general purposes of the aforesaid Pennsylvania Municipalities Planning Code, as amended. [1] In addition, compliance with the provisions enumerated herein and all current land use regulations cross-referenced within this chapter amendment text shall be deemed to be in compliance with the community development goals and objectives as stated in the West Deer Township Comprehensive Development Plan.

This chapter shall be known and may be cited as the "West Deer Township Subdivision and Land Development Ordinance."
