Any person who violates or permits the violation of any provision of this article or fails to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of the Code Official or of a permit or certificate issued under the provisions of this article, shall, in addition to any other remedy available under law or equity, be subject to a criminal fine in an amount not to exceed $1,000 for each violation or on default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days, plus the costs of prosecution, including reasonable attorneys' fees, for each violation. Each twenty-four-hour period that a violation continues after due notice has been served shall be deemed a separate offense. Enforcement of this article shall be by action brought before a Magisterial District Judge in the same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure. The Township Solicitor may assume charge of the prosecution without the consent of the District Attorney.
