The Adams Township recreation fee is hereby created as a source of revenue to promote and support recreational facilities and activities within the Township of Adams and to promote and support recreational facilities and activities which serve the recreational needs of the citizens of the Township.

A.
As part of the process of the issuance of building permits for construction of new residential dwellings within the Township, the Township shall charge, in addition to the building permit fees as set forth on the current Adams Township Fee Schedule, a recreation fee for each new single-family residential dwelling and a recreation fee for each dwelling unit within a new multifamily residential dwelling for which an application for building permit is received; said recreation fees shall be set from time to time by resolution of the Board of Supervisors. No building permit shall be issued by the Township for construction of a new single-family or multifamily residential dwelling without payment of all fees required under this section and those required by the current Adams Township Fee Schedule.

B. DWELLING DWELLING UNIT
For the purposes of this section, the following definitions shall apply:
Any structure or portion thereof which is built and used or to be used for residential purposes.
Any building or part thereof designed, built and occupied or to be occupied as a single housekeeping unit by one family.
Recreation fees received by the Township in accordance with the provisions of § 129-2 herein shall be deposited in a separate bank account titled the "Adams Township Recreation Fund." Such account shall be kept separate and apart from other Adams Township funds or accounts.
Monies deposited in the Adams Township Recreation Fund shall be utilized solely to promote and support recreational activities, facilities or purposes within the Township of Adams or to promote and support other recreational activities, facilities, and purposes which serve the recreational needs of the citizens of the Township. Such recreational activities, purposes, and facilities may include but not be limited to such matters as the purchase of real property for parks and/or recreational purposes, the purchase of recreational equipment or facilities, and the sponsoring, co-sponsoring, or financial support of recreational activities. Decisions as to the use of the Adams Township Recreation Fund assets shall be vested solely in the Adams Township Board of Supervisors.

The purpose of this article is to provide for the establishment of rules and regulations for the use and conduct of the Adams Township Community Park, so as to provide a safe, healthy and orderly use of the park and its facilities.
The Board of Supervisors shall, from time to time by resolution, establish and/or amend rules and regulations for the use and conduct of Adams Township Community Park.[1]

The rules and regulations established by resolution of the Board of Supervisors may be enforced by any law enforcement agency and/or any duly authorized representative of Adams Township charged with the administration and enforcement of this article.
Any person violating any of the provisions of this article shall be guilty of a summary offense and upon conviction thereof shall pay a civil penalty of not more than $300 nor less than $100, plus costs and reasonable attorney's fees incurred by the Township. Said fine shall be paid to the Adams Township General Fund. Each violation hereby shall constitute a separate offense and subject to a separate penalty as provided herein. Any person convicted of three or more violations of this article within a three-year period may be banned from the use of the park facilities by motion of the Board.
This article shall be effective five days after enactment.
Upon the effective date of this article, Ordinance No. 95 shall be repealed in its entirety. No other Adams Township ordinance shall be repealed by this article, either in whole or in part.
