No person shall ride or use a bicycle, which is defined as a device having two tandem wheels of a diameter on not less than 10 inches and propelled by human power, upon any street in the Borough of Westmont, unless the same shall be registered and licensed as hereinafter provided.
Every owner of a bicycle shall, within five days of the effective date of this chapter, list and register with the Chief of Police of the Borough of Westmont, or such person as may be designated by him, the name of the manufacturer of said bicycle and its number, style and general description.
The Chief of Police, or such person as may be designated by him, shall make such examination as may be required to determine that said bicycle is in good operating and/or mechanical condition; and, having determined the same, shall affix or cause to be affixed to the rear mud guard or frame of the bicycle an identification tag or plate, numbered serially to correspond with the bicycle registration. Such plate shall be affixed in such manner as to be plainly visible from the rear, and a registration card shall be issued to the owner of each such properly registered bicycle. The tag or license shall remain attached to the bicycle for which it is issued during the term for which such license is issued.
Bicycles shall be licensed initially for a term beginning September 1, 1955, and ending August 31, 1956, and shall be renewed annually thereafter for a term or period of one year. The operator of said bicycle shall at all times display his registration card, or produce satisfactory proof that he has such registration card within 24 hours upon the demand of any officer of the Borough of Westmont.
It shall be the duty of every person who sells or transfers ownership of any bicycle to report such sale or transfer to the Chief of Police, or such person as he may designate, and if the bicycle sold or transferred has been licensed and registered, he shall return to the said Chief of Police, or person designated, the registration card and license tag and shall report the name and address of the person to whom said bicycle was sold or transferred. Such report shall be made within five days after the date of sale or transfer, and it shall be the duty of said purchaser or transferee to apply immediately for registration and license tag.
It shall be unlawful for any person to remove, destroy, mutilate or alter the number of any bicycle frame, and if any bicycle does not have a serial number on the frame, or if such number is illegible, then the Chief of Police, or person designated, shall stamp an identification number on such frame of the bicycle. License tags or registration cards shall not be removed, destroyed, mutilated or altered during the term licensed.
Before issuing a registration card and license tag, each applicant shall be required to demonstrate personally, in such manner as shall be required by the Chief of Police, or person designated, that he or she is the lawful owner and is capable of riding said bicycle. Such applicant shall likewise demonstrate that he or she has satisfactory knowledge of safe riding rules and practices.

A. 
The operator of any bicycle upon the streets of the Borough of Westmont shall not carry any person upon the handlebars, frame or fenders of such bicycle, and it shall be unlawful for any person to so ride upon said bicycle.
B. 
It shall be unlawful for any operator of a bicycle to cling to any other moving vehicle.
Operators of bicycles shall not indulge in trick riding; shall keep at least one hand on the handlebars at all times while in use; shall not ride other than in single file, except to pass; and, when parking, shall do so in such manner as to afford the least obstruction to pedestrian and vehicular traffic.
Bicycles shall not be operated on the sidewalks of the Borough of Westmont, and when operated between one hour after sunset and one hour before sunrise, it shall be equipped with a headlight, visible from the front thereof for not less than 100 feet, and with a reflecting mirror or lamp in the rear, reflecting or exhibiting a red light, plainly visible under like conditions for a distance of 100 feet to the rear of said bicycle.
Any person convicted of the violation of the provisions of this chapter before the Mayor or a Justice of the Peace shall be subject to any one or any combination of the following penalties:
A. 
Impoundment:
(1) 
Impounding of the bicycle for not more than five days for the first offense.
(2) 
Impounding of the bicycle for not more than 10 days for the second offense.
(3) 
Impounding of the bicycle for not more than 15 days for the third offense.
B. 
A fine of not more than $1.
C. 
Revocation of the license for a period of not less than six months for a fourth offense.

The fee for the registration and licensing of a bicycle shall be as set forth from time to time by resolution of the Borough Council for each bicycle, and a like fee shall be paid for each renewal of said license.

Any bicycle owned and/or operated by a nonresident of the Borough of Westmont shall be subject to the provisions of this chapter; excepting that registration of said bicycle shall not be required unless said bicycle is kept in the Borough of Westmont for a period of more than 60 days.
